【摘要】： 長(zhǎng)久以來(lái),美國(guó)都以先進(jìn)文明的“美夢(mèng)之國(guó)”自詡,可是對(duì)于19世紀(jì)中后期至20世紀(jì)40年代在美國(guó)的中國(guó)移民來(lái)說(shuō)它卻是夢(mèng)魘的別稱。美國(guó)自19世紀(jì)80年代正式執(zhí)行排華政策,一直延續(xù)到第二次世界大戰(zhàn)的20世紀(jì)40年代為止。其利用反移民和反歸化的手段,給成千上萬(wàn)的中國(guó)人以及他們的后代帶來(lái)了深痛的災(zāi)難。由于司法力量在美國(guó)政治生活中的決定性作用,美國(guó)的一系列排華舉措離不開(kāi)法院的配合�？梢哉f(shuō),正是有了下至地區(qū)法院,上至聯(lián)邦最高法院的司法判例的支持,才使得整個(gè)排華運(yùn)動(dòng)能夠“轟轟烈烈”的進(jìn)行了長(zhǎng)達(dá)一個(gè)世紀(jì)之久。 本文正是基于這樣的背景,從研究美國(guó)排華的形成和動(dòng)因出發(fā),以時(shí)間為主線,結(jié)合各個(gè)時(shí)期的社會(huì)背景、立法背景以及代表性的司法判例,以大量真實(shí)的材料和案例揭露了美國(guó)所謂民主的假面和所謂平權(quán)的虛偽�，F(xiàn)在國(guó)際社會(huì)又掀起新一輪的以美國(guó)等西方國(guó)家為首的反華高潮,回?fù)羲麄冏詈玫奈淦骶褪撬麄冏约翰还獠实臍v史,本文恰恰可以給那些能夠客觀公正評(píng)判歷史的人士提供一個(gè)新的參考視點(diǎn)。
[Abstract]:The United States has long prided itself as the "dream country" of advanced civilization, but for Chinese immigrants in the United States from the middle of the 19th century to the 1940s, it was a nickname for a nightmare. Since the 1880s, the United States carried out a policy of Chinese exclusion, which lasted until the 1940s of the second World War. Its use of anti-immigration and anti-naturalization has brought deep suffering to thousands of Chinese and their descendants. Due to the decisive role of judicial power in American political life, a series of anti-Chinese measures in the United States can not be separated from the cooperation of the courts. It can be said that with the support of judicial precedents from the District Court to the Supreme Court, the whole anti-China movement has been going on for a century. This article is based on this background, from the study of the formation and motivation of the United States anti-Chinese, with time as the main line, combined with the social background of each period, legislative background and representative judicial precedents. The false appearance of democracy and the hypocrisy of equal power are exposed with a great deal of truthful materials and cases. Now the international community has set off a new round of anti-China climax led by the United States and other Western countries. The best weapon to fight back against them is their own disgraceful history. This paper can provide a new reference point for those who can judge history objectively and justly.
