【摘要】：雅典城邦公民權(quán)是雅典公民集體的成員身份與權(quán)利的統(tǒng)一。它不僅包括公民的世襲身份特權(quán),也包括與此相一致的表決權(quán)(投票權(quán))、執(zhí)政權(quán)、司法權(quán)等諸多權(quán)利。 古希臘人的公民觀念和權(quán)利意識(shí)萌發(fā)于荷馬社會(huì),而雅典人的公民集體意識(shí)與公民權(quán)觀念則于古風(fēng)時(shí)代隨著城邦制度的初興而產(chǎn)生。其后,梭倫改革使雅典城邦公民集體和公民權(quán)得以初步形成。 庇西特拉圖時(shí)代、克里斯提尼時(shí)代和伯里克利時(shí)代是雅典城邦公民權(quán)充分發(fā)展的歷史時(shí)期。庇西特拉圖的僭主制使梭倫改革所創(chuàng)設(shè)的雅典城邦公民權(quán)在制度上得以延續(xù)和完善;克里斯提尼的改革通過德莫及新的行政區(qū)劃使雅典城邦公民權(quán)獲得以地域關(guān)系為主體的權(quán)力基礎(chǔ),基本實(shí)現(xiàn)了其在投票、擔(dān)任官職和充當(dāng)陪審員方面的統(tǒng)一與適用;伯里克利的改革則為雅典城邦公民權(quán)的充分發(fā)展提供了古代世界民主制政體最為周全的政策,基于公民權(quán)廣泛適用的雅典民主政治達(dá)到鼎盛,并成為伯里克利時(shí)代特色鮮明的古典遺產(chǎn)。 伯羅奔尼撒戰(zhàn)爭之后,雅典城邦制度全面衰微,作為雅典城邦制度核心的公民集體與公民權(quán)機(jī)制隨之廢弛。
[Abstract]:The citizenship of Athens city-state is the unity of membership and right of Athenian citizens. It includes not only the privilege of hereditary identity of citizens, but also the rights of voting rights (voting rights), ruling power, judicial power and so on. The concept of citizenship and right of the ancient Greeks originated in Homer society, while the concept of collective and civil rights of the Athenians came into being in the ancient times with the beginning of the city-state system. After that, Solon reform made the citizen collective and citizenship of Athens city-state formed initially. The Percitrato era, the Christinique era and the Pericles era were the historical periods in which the citizenship of the Athenian city-states developed fully. The tyrant system of Pishitratu made the citizenship of Athens city-state established by the Solon reform continue and perfect in the system. Through Demo and the new administrative division, the reform of Christinique made the citizenship of Athens city-state gain the power base of regional relation, and realized its unification and application in voting, serving as official post and serving as juror. The reform of Pericles provided the most comprehensive policy of the ancient world democratic system for the full development of the citizenship of the Athenian city-state. And became a distinctive classical heritage of the Pericles era. After the Peloponnesian War, the system of Athenian city-state declined completely, and the mechanism of citizen collective and citizenship, which was the core of Athens city-state system, was abolished.
