【摘要】： 家庭是構成社會有機整體的基本單位,是社會的細胞,而婚姻則是維系家庭的紐帶,同時也是人們了解整個社會的一個重要窗口�；橐鲆约芭c婚姻有關的思想與行為,不僅從側面折射出某一社會文明進化的程度,而且也能直接彰顯出相關社會的某些內在特征。作為社會關系中最為重要的紐帶之一,婚姻關系在不同時代都深刻地反映了那個時代的政治、經濟、法律及社會風俗習慣。本文即從家庭財產分配的角度展開分析,結合中世紀晚期和近代早期英國社會的宏觀歷史背景探討家庭財產分配方式的演變與社會整體發(fā)展的相互關系。轉型時期新的家庭財產分配方式的出現(xiàn),包括女兒嫁妝形式及支付方式的變化,婦女“獨立財產”的建立,亡夫遺產的演變以及遺囑權的廣泛運用,都是社會發(fā)展在家庭財產分配方式上留下的烙印。財產分配方式的新變化也同樣折射出社會的進步,體現(xiàn)出產權制度逐步明晰化的過程,反映出資產階級要求平等,倡導個人意志自由的思想。文章力求透過家庭財產分配方式的變化,加深對英國社會轉型時期的理解。
[Abstract]:Family is the basic unit and cell of society, and marriage is the bond to maintain the family, and it is also an important window for people to understand the whole society. Marriage and the thoughts and behaviors related to marriage not only reflect the degree of the evolution of a certain social civilization from the side, but also directly reveal some inherent characteristics of the related society. As one of the most important ties in social relations, marriage reflects deeply the political, economic, legal and social customs of that era. From the angle of family property distribution, this paper discusses the relationship between the evolution of family property distribution mode and the overall development of the society, combining with the macroscopic historical background of the British society in the late Middle Ages and the early modern times. During the transition period, the emergence of new ways of family property distribution, including the changes in the form of dowry and payment of daughters, the establishment of women's "independent property", the evolution of their deceased husbands' inheritance and the widespread use of testamentary rights, Both are the imprints left by social development in the distribution of family property. The new changes in the way of property distribution also reflect the progress of society, reflect the process of gradual clarification of property rights system, reflect the bourgeoisie's idea of asking for equality and advocating the freedom of individual will. The article tries to deepen the understanding of the transition period of British society through the change of family property distribution.
