【摘要】：在中古盛期的英國,"市場"概念具有豐富而深刻的內(nèi)涵。就經(jīng)濟維度而言,市場是一種發(fā)育尚不成熟的商品交易場所,是封建社會中商品經(jīng)濟和自然經(jīng)濟對立統(tǒng)一下的經(jīng)濟混合體。就法權(quán)維度來看,市場是一項法律特權(quán),是普通法形成和領(lǐng)主法權(quán)參與的共同結(jié)果。就人為因素而言,市場是國王和領(lǐng)主獲得經(jīng)濟利益和滿足政治需求的一種互利工具。這表明,中古盛期英國市場其實是一種"特許"市場。
[Abstract]:In the middle-ancient England, the concept of "market" has a rich and profound connotation. As far as economic dimension is concerned, market is a kind of immature commodity trading place, which is a mixture of commodity economy and natural economy under the unity of opposites in feudal society. From the perspective of legal power, the market is a legal privilege and a common result of the formation of common law and the participation of the lord. In human terms, the market is a mutually beneficial tool for the king and lord to obtain economic benefits and meet political needs. This shows that the British market in the Middle Ages was actually a "franchise" market.
