【摘要】：16世紀(jì),英格蘭公簿持有農(nóng)的土地權(quán)利安全性問題對于理解社會轉(zhuǎn)型期的英國至關(guān)重要。從土地繼承權(quán)來看,公簿持有農(nóng)基本享有自由的土地繼承權(quán)。從地租來看,公簿持有農(nóng)交納的地租大體上比較穩(wěn)定,領(lǐng)主不能任意提高地租。16世紀(jì),公簿持有農(nóng)的土地權(quán)利已經(jīng)開始受到法律保護。進入費(entry fines)是公簿持有農(nóng)和領(lǐng)主爭議的焦點,但總體來看,莊園習(xí)慣法在決定進入費方面比領(lǐng)主的意志更重要。
[Abstract]:In the 16 th century, the security of the land rights of farmers in the public book of England was very important to understand Britain in the social transition period. From the perspective of land inheritance rights, the public book holds that farmers enjoy the basic freedom of land inheritance rights. From the point of view of the land rent, the land rent paid by the public farmers is generally stable, and the lord can not raise the rent arbitrarily in the 16th century, and the land rights of the farmers held by the public book have been protected by law. Entry fines is the focus of the dispute between the owner and the owner, but generally speaking, the manor customary law is more important than the will of the lord in determining the entry fee.
