盎格魯—撒克遜法探析

【摘要】:羅馬人撤出不列顛之時,來自歐洲大陸北部的日耳曼部落相繼移居不列顛,其中占據(jù)主體的是盎格魯人(Angels)、撒克遜人(Saxons)和朱特人(Jutes)等三個部落,常常被統(tǒng)稱作“盎格魯-撒克遜人’(Anglo-Saxons)。隨著盎格魯-撒克遜人皈依基督教,教會輸入歐洲大陸的觀念和技術(shù),開始將盎格魯-撒克遜人的古老習(xí)慣記錄下來,由此而出現(xiàn)第一部盎格魯-撒克遜法典《埃塞爾伯特法典》(Laws of AEthelberht)。從肯特國王埃塞爾伯特(AEthelberht)開始,一系列的盎格魯-撒克遜法典先后頒行,直到最后一部的《克努特法典》(Laws of Cnut)為止,這些盎格魯-撒克遜時代成文的法律文本,統(tǒng)稱作盎格魯-撒克遜法典。本文正是依據(jù)這些法律文獻,對盎格魯-撒克遜法的形成過程予以考察,以期對認(rèn)識英國早期歷史而有所助益。 全文共有九個部分,包括緒論和八章正文內(nèi)容。 緒論主要包括對國內(nèi)外研究的狀況的梳理和總結(jié),以及背景知識的敘述,即盎格魯-撒克遜史述略。 第一章主要探討盎格魯-撒克遜法的成文化進程,著重對十多部法典和其他法律文本予以介紹和考述。 第二章探討這一時代英格蘭社會等級的劃分及其演變,考察當(dāng)時人們在法律上的不同地位。首先考察貴族等級的情形,著重分析厄德曼(ealdorman)、格塞特(gesith)和塞恩(thegn)三種貴族等級;其次,探討普通自由民等級刻爾(ceorl),以及刻爾地位的變遷和分化。緊接著論述非自由民等級的情況,著重分析奴隸的來源和釋放問題。最后,筆者對社會等級關(guān)系中的變化,進行了分析和總結(jié)。 第三章考察盎格魯-撒克遜司法審判制度。筆者先對早期集會的司法功能進行考察,然后分析賢人會議(Witan)的審判職能。緊接著,筆者論述10世紀(jì)地方法庭的興起,包括郡(Shire)、百戶區(qū)(Hundred)和市鎮(zhèn)(Borough)法庭。然后,探討諾曼征服前領(lǐng)主司法權(quán)的出現(xiàn),最后,對盎格魯-撒克遜時代的審判機制予以論述。 第四章討論當(dāng)時不法行為的種類及其規(guī)制,以現(xiàn)代觀念來看,應(yīng)當(dāng)屬于刑事法律的范疇。筆者分別從殺人、人身傷害、盜竊和通奸等方面敘述。 第五章探討有關(guān)土地制度的法律習(xí)慣。首先,筆者考察早期民田(folk-land)的情況,以及七世紀(jì)書田(book-land)的產(chǎn)生和發(fā)展。然后,論述民田和書田的具體實踐。最后,探討土地關(guān)系中封建制萌芽問題。 第六章考察有關(guān)動產(chǎn)的法則,著重分析了動產(chǎn)的管制、買賣,以及動產(chǎn)的可讓渡、繼承和遺贈等情況。 第七章論述當(dāng)時有關(guān)婚姻和家庭的法則。筆者分別由家族制度、婚姻制度、夫妻關(guān)系和親子關(guān)系四個方面來論述。 最后是余論部分。筆者先論述了盎格魯-撒克遜法的特點,然后,探討法律對中世紀(jì)早期英格蘭社會的影響,分別由教會和法律、國王和法律的關(guān)系,來予以分析和探究。
[Abstract]:When the Romans withdrew from Britain, the Germanic tribes from northern Europe migrated to Britain, dominated by three tribes, the Anglo-American Angles, Saxonsof Saxonsand Jutes. The Anglo-Saxons are often referred to as the Anglo-Saxons. With the conversion of the Anglo-Saxons to Christianity and the introduction of European ideas and techniques into the church, the ancient habits of the Anglo-Saxons began to be recorded. Thus came the first Anglo-Saxon Code, laws of Aethelberhtl. From King Ethel Bert of Kent to Aethelberht, a series of Anglo-Saxon codes were enacted, until the last Code of Canute, laws of Cnutts, which was written in the Anglo-Saxon era, Collectively known as the Anglo-Saxon Code. Based on these legal documents, this paper examines the formation process of Anglo-Saxon law in order to help to understand the early history of England. There are nine parts in this paper, including introduction and eight chapters. The introduction mainly includes combing and summing up the research situation at home and abroad, as well as the narration of background knowledge, that is, Anglo-Saxon history. The first chapter mainly discusses the cultural process of Anglo-Saxon law, focusing on the introduction of more than ten codes and other legal texts. The second chapter discusses the classification and evolution of social hierarchy in England, and examines the different legal status of people at that time. This paper first examines the situation of aristocratic rank, focusing on the analysis of three kinds of aristocratic classes: Edelman, Gesett and Thain. Secondly, it discusses the ordinary free people's rank, and the evolution and differentiation of the Cher's status. Then it discusses the status of non-free people, focusing on the origin and release of slaves. Finally, the author analyzes and summarizes the changes in the social hierarchy. Chapter three examines the Anglo-Saxon judicial system. The author examines the judicial function of the early assembly, and then analyzes the judicial function of Witan. Then, the author discusses the rise of the local courts in the 10th century, including Shirei, Hundred and Borough. Then, the emergence of the Lord before the Norman Conquest was discussed. Finally, the trial mechanism of the Anglo-Saxon era was discussed. The fourth chapter discusses the types and regulations of illegal acts at that time, which should belong to the category of criminal law from the view of modern concept. The author narrates from the aspects of murder, personal injury, theft and adultery respectively. The fifth chapter discusses the legal custom of land system. First of all, the author examines the early folk-land, and the emergence and development of book-land in the seventh century. Then, the paper discusses the concrete practice of Mintian and Shutian. Finally, the paper discusses the germination of feudal system in land relations. Chapter six examines the law of movable property, and analyzes the regulation, sale, transferability, inheritance and bequest of movable property. The seventh chapter discusses the law of marriage and family at that time. The author discusses the family system, marriage system, marital relationship and parent-child relationship respectively. The last part is the conclusion. The author first discusses the characteristics of Anglo-Saxon law, and then probes into the influence of law on the early medieval English society, which is analyzed and explored by the relationship between church and law, king and law, respectively.
