【摘要】：本文以定性分析法為主,兼采文獻、個案、信息以及跨學(xué)科等多方位的研究方法,對20世紀初期到40年代為止的早期美國毒品控制的外交模式、法律懲戒模式以及醫(yī)療模式這三個方面進行了結(jié)構(gòu)性的梳理與學(xué)術(shù)上的組建,以求從中摸索出美國毒品控制體系在其形成與早期發(fā)展過程中所存在的經(jīng)驗與教訓(xùn),從而對這一至今百年有余的國家毒品控制體系的歷史有一個立體性的深度認識。 美國毒品控制模式是一個圍繞著如何控制并消滅非醫(yī)用的成癮性麻醉品而構(gòu)成的巨大禁毒體系。該模式由美國內(nèi)政外交諸因素構(gòu)建而成,它不但涉及美國外交政策理念、國家政治制度、立法執(zhí)法體系與聯(lián)邦各個層面的權(quán)力結(jié)構(gòu)等上層建筑領(lǐng)域的因素,而且還關(guān)系到美國的社會道德理念、歷史文化、醫(yī)療衛(wèi)生以及意識形態(tài)等方方面面的內(nèi)容。 國內(nèi)外史學(xué)界對于美國禁毒史的研究多集中于美國毒品政策的立法與執(zhí)法上,對于外交模式的研究也多局限于禁毒外交如何服務(wù)于國內(nèi)法內(nèi)容上,至于醫(yī)療模式的研究則基本上歸之于社會控制以及醫(yī)藥學(xué)領(lǐng)域的類別中,很少從歷史的角度觀察它并將之列為毒品控制模式的一個不可或缺的內(nèi)容,更惶談從整個模式的角度去推敲其相互間的能動關(guān)系及其各自的獨立性與歷史地位。事實上,學(xué)界尤其是海外學(xué)界對于美國禁毒史的研究發(fā)展至今,已經(jīng)達到了一個資料豐富且學(xué)術(shù)討論非�；钴S的階段。即使在法律政策史的研究上也向著更為縱深和微觀的領(lǐng)域發(fā)展,而不斷解密的檔案資料則無疑為此提供了可能。因此,如何在研究中有所突破已成為現(xiàn)代學(xué)者在禁毒史領(lǐng)域的共同研究課題。 鑒于上述的學(xué)術(shù)研究現(xiàn)狀,本文立足于從歷史的角度出發(fā),以定性分析法為依據(jù),首次將業(yè)已存在的美國毒品控制體系冠之以美國毒品控制模式之名。在去蕪存菁的基礎(chǔ)上,本文將聯(lián)邦層面上最為重要的禁毒外交政策、禁毒法體系以及成癮醫(yī)療的三個方面攬括為基本內(nèi)容,重新構(gòu)建了美國毒品控制模式的立體式框架。以此框架為據(jù),在認真分析文獻與吸取前輩學(xué)者的學(xué)術(shù)成果基礎(chǔ)上,以時間為綱、事件為目,輔之以跨學(xué)科的、多方位的信息處理方法,力圖從內(nèi)政外交的多方位對模式三方面的的各自內(nèi)容加以梳理,從而在挖掘早期聯(lián)邦毒品控制模式內(nèi)容間的相互能動關(guān)系及其實施過程中的經(jīng)驗與教訓(xùn)的同時,全面展示“禁止”理念基礎(chǔ)上的美國聯(lián)邦毒品控制模式的價值取向,進而為理解現(xiàn)行美國“毒品戰(zhàn)爭”提供一個有價值的學(xué)術(shù)參考。
[Abstract]:This paper focuses on qualitative analysis, and adopts literature, case studies, information and interdisciplinary research methods to study the early American drug control diplomatic model from the early 1900s to the 1940s.In order to find out the experience and lessons of the American drug control system in the process of its formation and early development, the three aspects of legal punishment model and medical treatment model are combed structurally and academically constructed, in order to find out the experience and lessons of the American drug control system in the process of its formation and early development.Thus, the history of the national drug control system, which has been more than a hundred years, is understood in a stereoscopic way.The American drug control model is a huge drug control system which revolves around how to control and eliminate non-medical addictive drugs.This model is constructed by various factors of American domestic and foreign affairs. It not only involves American foreign policy concept, national political system, legislation and law enforcement system, and power structure at all levels of the Federation, etc., it not only involves the factors of superstructure in the field of American foreign policy.But also related to American social and moral philosophy, history and culture, health care and ideology and other aspects of the content.Domestic and foreign historians mostly focus on the legislation and law enforcement of the drug policy of the United States, and the study of the diplomatic model is limited to how to serve the content of domestic law.As for the study of medical model, it is basically classified in the field of social control and medicine and pharmacy, and it is rarely viewed from a historical point of view and made an indispensable part of drug control model.From the point of view of the whole mode, the dynamic relationship between them and their independence and historical status should be examined.As a matter of fact, the research on the history of drug control in the United States has reached a stage of abundant information and very active academic discussion.Even in the study of the history of law and policy, it has developed to a deeper and microcosmic field, and the unceasing declassification of archival materials has undoubtedly provided the possibility for this.Therefore, how to break through in the research has become a common research topic of modern scholars in the field of drug-control history.In view of the above academic research status, this paper bases on the historical point of view, based on the qualitative analysis method, the existing drug control system in the United States as the first time as the United States drug control model.In this paper, the most important foreign policy of drug control at the federal level, the drug law system and the three aspects of addictive medicine are included as the basic contents, and the three-dimensional framework of the American drug control model is re-constructed.Based on this framework, on the basis of careful analysis of the literature and drawing on the academic achievements of previous generations of scholars, with time as the outline, events as the objective, supplemented by interdisciplinary, multi-directional information processing methods,Trying to comb the contents of the three aspects of the mode from various aspects of domestic and foreign affairs, so as to excavate the mutual dynamic relationship among the contents of the early federal drug control mode and the experience and lessons in the process of implementation, at the same time,A comprehensive display of the value orientation of the federal drug control model based on the concept of "prohibition" provides a valuable academic reference for the understanding of the current American "drug war".
