【摘要】： 攝政制度是代行國王權(quán)力的一種手段。英國攝政制度經(jīng)過四五百年的歷史發(fā)展過程,最終于1937年以成文法的形式確立。1534-1553年間是攝政制度的起源時(shí)期。在此期間,英國經(jīng)歷了攝政制度的法律準(zhǔn)備時(shí)期和實(shí)踐摸索時(shí)期。在愛德華六世繼位之前,亨利八世通過多項(xiàng)議會(huì)法案,確立了攝政制度的相關(guān)原則,并在其遺囑中具體規(guī)定了愛德華六世時(shí)期攝政的形式及人員。這些法律上的準(zhǔn)備并不能完全解決攝政問題,亨利八世去世以后,他所指定的遺囑執(zhí)行委員會(huì)成員經(jīng)歷了3個(gè)月的摸索,探求攝政的形式和攝政者或攝政機(jī)構(gòu)的合法性來源,并最終確立了由單一攝政者攝政的形式。這種攝政形式一經(jīng)形成,在愛德華六世在位期間未曾發(fā)生根本變化。此次攝政確立了英國攝政制度的基本原則,此后英國的攝政制度也是在此次攝政所確立的形式的基礎(chǔ)上逐漸完善的。
[Abstract]:The Regency system is a means of acting the power of the king. After four or five hundred years of historical development, the British Regency system was finally established in the form of written law in 1937. Britain experienced a period of legal preparation and practice exploration of the regency system. Before Edward VI succeeded him, Henry VIII adopted a number of parliamentary acts to establish the principles of the regency system. And specified in his will the form and personnel of the Regency of Edward VI. These legal preparations did not completely solve the regency problem, and after Henry VIII's death, The members of the probate executive committee appointed by him spent three months exploring the form of regent and the source of legitimacy of the regent or regent, and eventually establishing the form of regency by a single regent, once such a form of regency was formed, There was no fundamental change during the reign of Edward VI. The regency established the basic principles of the British regency system, and since then the British regency system has been gradually perfected on the basis of the form established by the regency.
