【摘要】： 自由與憲政成為當(dāng)代民主國(guó)家的主流政治價(jià)值,也是非民主國(guó)家向民主轉(zhuǎn)型的方向。哈耶克指出,使國(guó)家處于一種良好的秩序中運(yùn)行,來(lái)實(shí)現(xiàn)法律體制中的自由。從殖民時(shí)代開(kāi)始,美國(guó)人對(duì)自由主義有很深刻的認(rèn)識(shí)和理解。隨著反對(duì)英國(guó)的殖民統(tǒng)治和獨(dú)立戰(zhàn)爭(zhēng)的勝利,自由主義成為美國(guó)人根深蒂固的價(jià)值取向。美國(guó)聯(lián)邦政府頒布了第一部聯(lián)邦憲法,采用了代議制和分權(quán)與制衡機(jī)制,對(duì)政府權(quán)力進(jìn)行限制;開(kāi)國(guó)先輩并將其付諸于實(shí)踐,使其體制化,捍衛(wèi)了憲法的精神,夯實(shí)了作為一個(gè)自由國(guó)家的根基,把美國(guó)引向了一條良治的自由憲政之路。本文擬將以自由為出發(fā)點(diǎn),通過(guò)分析聯(lián)邦建立初期美國(guó)憲法政治的設(shè)計(jì)和實(shí)踐,來(lái)研究其政治中的自由憲政秩序。
[Abstract]:Freedom and constitutionalism have become the mainstream political values of contemporary democracies, and they are also the direction of the transition from non-democracies to democracy. Hayek pointed out that the state is functioning in a good order. From the colonial era, Americans had a deep understanding and understanding of liberalism. With the victory against British colonial rule and the War of Independence, Liberalism became a deep-rooted value orientation in the United States. The federal government enacted the first federal constitution, which adopted a system of representation and separation of powers and checks and balances to limit the power of government; founded and put it into practice. To institutionalize it, to defend the spirit of the Constitution, to consolidate the foundation of being a free country, and to lead the United States to a free constitutional road of good governance. By analyzing the design and practice of American constitutional politics in the early days of federal establishment, this paper studies the free constitutional order in American politics.
