18世紀英國勞資糾紛化解機制的嬗變

【摘要】:隨著18世紀英國工業(yè)革命的開展,勞資糾紛與沖突日趨普遍與激烈。為此,英國政府積極變革勞資糾紛化解機制,改變前工業(yè)化時期以管制為核心的家長制勞資糾紛化解機制,轉而采用以仲裁為主要內(nèi)容的勞資糾紛化解機制。英國勞資糾紛化解機制的這一嬗變,發(fā)端于1756年法令的存廢之爭,完成于1800年《結社法》的頒布?v觀18世紀英國推行勞資立法的實況,以家長制勞工立法為核心內(nèi)容的厘定工資條款和學徒制條款漸次廢弛,而仲裁條款成為勞工法令的新內(nèi)容。與此同時,作為國家化解勞資糾紛的權力主體,治安法官逐漸放棄"家長"的角色,轉而發(fā)揮"仲裁者"的角色,仲裁制遂取代家長式管制,成為18世紀后期英國勞資糾紛化解的重要機制。
[Abstract]:With the development of British Industrial Revolution in 18th century, labor disputes and conflicts became more and more common and fierce. This evolution of the industrial dispute resolution mechanism in the United Kingdom originated in the controversy over the retention and abolition of the Act of 1756. The enactment of the Associations Act on 1800. Looking at the actual situation of the labour legislation implemented in the United Kingdom on 18th century, the wage and apprenticeship provisions, which are the core content of the paternalistic labor legislation, are gradually abolished. The arbitration clause has become a new part of the labor law. At the same time, as the subject of the state's power to resolve industrial disputes, magistrates gradually give up their role as "parents" and instead play the role of "arbiter". Arbitration system replaced paternalistic regulation and became an important mechanism to resolve industrial disputes in Britain in late 18th century.
