【摘要】:婚姻是一定社會(huì)制度所確認(rèn)的男女兩性的結(jié)合以及由此而產(chǎn)生的夫妻關(guān)系。而夫妻關(guān)系是最基本的男女兩性關(guān)系,也是婚姻關(guān)系的主體。當(dāng)代中國(guó),在婚姻大都忠實(shí)的主流趨勢(shì)下,隨著市場(chǎng)經(jīng)濟(jì)的發(fā)展和現(xiàn)代化進(jìn)程腳步的加快,人們的思想觀念發(fā)生了巨大的改變,反映在婚姻家庭領(lǐng)域就是一些人過(guò)度重視自我感覺(jué),片面地追求性自由,對(duì)配偶和家庭的責(zé)任感日趨淡化,導(dǎo)致婚姻不忠實(shí)現(xiàn)象呈上升趨勢(shì)。 本文中所講的婚姻忠實(shí)不僅僅包括夫妻在感情方面的專(zhuān)一,不在婚外進(jìn)行性行為,還包括夫妻任何一方不得隨意拋棄另一方,不能為除配偶之外的第三者利益去損害配偶一方的權(quán)利和利益。本文從婚姻忠實(shí)的本質(zhì)入手,探尋與婚姻忠實(shí)相關(guān)的一系列問(wèn)題,并從倫理學(xué)角度對(duì)這些問(wèn)題進(jìn)行了分析,提出了解決婚姻不忠實(shí)問(wèn)題的途徑。論文共分三章來(lái)闡述當(dāng)代中國(guó)婚姻忠實(shí)問(wèn)題。 第一章,根據(jù)婚姻及婚姻忠實(shí)的定義,分析得出婚姻忠實(shí)的本質(zhì)是愛(ài)和責(zé)任。一方面,婚姻生活中愛(ài)是責(zé)任的基礎(chǔ);另一方面,責(zé)任又是愛(ài)的具體化和現(xiàn)實(shí)化的表現(xiàn),是愛(ài)得以實(shí)現(xiàn)的根本保障。文章在此基礎(chǔ)上對(duì)婚姻忠實(shí)問(wèn)題進(jìn)行了分析研究,闡述了馬克思主義經(jīng)典作家在婚姻忠實(shí)問(wèn)題方面的主要觀點(diǎn):只有夫妻間彼此相愛(ài)互相忠實(shí)才能實(shí)現(xiàn)婚姻的真正幸福。 第二章,對(duì)當(dāng)代中國(guó)婚姻忠實(shí)現(xiàn)狀進(jìn)行研究,通過(guò)對(duì)調(diào)查數(shù)據(jù)的分析,總結(jié)歸納出婚姻忠實(shí)的特征。在當(dāng)代中國(guó),婚姻忠實(shí)是主流趨勢(shì),但也存在著許多婚姻不忠的情況。通過(guò)對(duì)婚姻不忠行為的分析,闡述了婚姻不忠出現(xiàn)的主客觀原因,論述了婚姻不忠行為對(duì)社會(huì)、配偶、家庭及子女身心健康造成的危害,指出了婚姻不忠不僅影響和睦的夫妻關(guān)系和良好的家庭秩序,而且可能造成血緣混亂,給家庭和社會(huì)帶來(lái)災(zāi)難。 第三章,從倫理學(xué)的角度出發(fā),指出婚姻忠實(shí)是健康的婚姻生活對(duì)人們的道德要求;橐鲋覍(shí)既要有法律的保護(hù),又需要道德的調(diào)整,兩者缺一不可。此外,維護(hù)婚姻忠實(shí)除了必要的法律途徑和道德手段外,也可以通過(guò)社會(huì)輿論和正面的宣傳工作。最后文章強(qiáng)調(diào)夫妻雙方應(yīng)該提升自身的素質(zhì),以更好地維護(hù)夫妻忠實(shí),建立和諧良好的婚姻關(guān)系。 婚姻忠實(shí),既是婚姻關(guān)系的倫理要求,也是夫妻關(guān)系的自然屬性。無(wú)論是在倫理意義上還是在法律意義上,婚姻忠實(shí)都能更好地維護(hù)婚姻關(guān)系、家庭的和睦和社會(huì)的長(zhǎng)治久安。
[Abstract]:Marriage is the combination of men and women recognized by certain social system and the conjugal relationship arising therefrom. Husband and wife relationship is the most basic relationship between men and women, but also the subject of marriage. In contemporary China, with the development of market economy and the acceleration of modernization, people's ideas have changed greatly under the mainstream trend of marriage. Reflected in the field of marriage and family, some people pay too much attention to their own feelings, pursue sexual freedom in a one-sided way, and their sense of responsibility towards spouses and families is diminishing day by day. The marriage faithfulness mentioned in this paper includes not only the relationship between husband and wife, not sex outside marriage, but also the fact that neither spouse should abandon the other party at will. The rights and interests of one spouse cannot be compromised for the benefit of a third party other than the spouse. Starting with the essence of marriage faithfulness, this paper explores a series of problems related to marriage faithfulness, analyzes these problems from the point of view of ethics, and puts forward the ways to solve the problem of marriage faithfulness. The thesis is divided into three chapters to expound the problem of marriage loyalty in contemporary China. The first chapter, according to the definition of marriage and marriage faithfulness, concludes that the essence of marriage faithfulness is love and responsibility. On the one hand, love is the basis of responsibility in marriage; on the other hand, responsibility is the embodiment and reality of love, which is the fundamental guarantee for the realization of love. On the basis of this, the article makes an analysis and research on the problem of marriage faithfulness. This paper expounds the main viewpoints of Marxist classical writers on marriage faithfulness: only couples love each other and each other faithful can realize the true happiness of marriage. Chapter two studies the present situation of marriage faithfulness in contemporary China. Through the analysis of the survey data, summarized the characteristics of marriage loyalty. In contemporary China, marriage loyalty is the mainstream trend, but there are also many cases of marital infidelity. Based on the analysis of marital infidelity, this paper expounds the subjective and objective causes of marital infidelity, and discusses the harm caused by marital infidelity to the health of society, spouse, family and children. It is pointed out that marital infidelity not only affects the harmonious relationship between husband and wife and good family order, but also may cause blood disorder and bring disaster to family and society. It is pointed out that marriage loyalty is the moral requirement of healthy marriage life. Marriage loyalty not only has legal protection, but also needs moral adjustment, both of which are indispensable. Besides the necessary legal and moral means, the maintenance of marriage loyalty can also be carried out through public opinion and positive propaganda. Finally, the article emphasizes that both husband and wife should improve their own quality in order to better maintain the loyalty of husband and wife and establish harmonious and good marriage relationship. Marriage faithfulness is not only the ethical requirement of marital relationship, but also the natural attribute of marital relationship. In both ethical and legal sense, marriage loyalty can better maintain marital relations, family harmony and social stability.
