【摘要】：在環(huán)境糾紛中,科技專家成為科學(xué)的代表,被社會(huì)寄予厚望,但也可能存在失責(zé)風(fēng)險(xiǎn)。研究發(fā)現(xiàn),存在依次遞進(jìn)的三類失責(zé)行為:一是彈性選擇;二是隱瞞觀點(diǎn);三是故意扭曲�？萍紝＜业氖ж�(zé)行為源于系統(tǒng)整合漏洞和社會(huì)整合不足。前者表現(xiàn)在三個(gè)方面,監(jiān)督體制不完善導(dǎo)致道德失責(zé)風(fēng)險(xiǎn),獎(jiǎng)懲體制失當(dāng)導(dǎo)致法律失責(zé)風(fēng)險(xiǎn),政治權(quán)力脅迫產(chǎn)生科學(xué)失責(zé)風(fēng)險(xiǎn)。后者的問題主要是:道德約束偏弱導(dǎo)致科技專家的彈性選擇,科技專家與受害者存在隔閡導(dǎo)致其隱藏信息,經(jīng)濟(jì)利益為核心驅(qū)動(dòng)力導(dǎo)致"故意扭曲"行為產(chǎn)生。因此,為了杜絕科技專家的失責(zé)行為,社會(huì)系統(tǒng)需要一套寬松有度、邏輯嚴(yán)密的頂層設(shè)計(jì),實(shí)現(xiàn)各子系統(tǒng)之間的功能整合,讓科技專家敢于、樂于恪盡職守。
[Abstract]:In environmental disputes, science and technology experts become the representatives of science and technology, which are expected by the society, but they may also have the risk of default. The study found that there are three kinds of default behaviors in turn: one is flexible choice, the other is concealment of point of view; Third, intentional distortion. The default behavior of science and technology experts originates from systematic integration loophole and social integration. The former is manifested in three aspects, the imperfect supervision system leads to moral default risk, the reward and punishment system misconduct leads to legal default risk. The problems of the latter are that weak moral constraints lead to flexible selection of science and technology experts, and the gap between scientific experts and victims leads to hidden information. Therefore, in order to put an end to the dereliction of duty of science and technology experts, the social system needs a set of loose and logical top-level design to realize the functional integration between subsystems. Let science and technology experts dare and be willing to fulfill their duties.
