【摘要】：當(dāng)前社會(huì),隨著老年人口的增加和老齡化的加劇,給社會(huì)帶來(lái)了巨大的挑戰(zhàn)。一方面是經(jīng)濟(jì)的發(fā)展,矛盾沖突的加劇,老年人群體的各項(xiàng)權(quán)利受到侵害,另一方面是司法社工作為司法戰(zhàn)線上的柔性管理者,在民事權(quán)利維護(hù)等方面介入的不到位。已經(jīng)有很多學(xué)者對(duì)老年人的這些問(wèn)題進(jìn)行了研究。但目前關(guān)于司法社會(huì)工作介入老年人贍養(yǎng)權(quán)保護(hù)研究還是一片空白,還有很多問(wèn)題需要研究和論證。筆者從老年人的贍養(yǎng)權(quán)受侵害的案件出發(fā),探討在司法社會(huì)工作理論的指導(dǎo)下,運(yùn)用社會(huì)工作的方法——個(gè)案工作,在分析司法社會(huì)工作介入到老年人贍養(yǎng)權(quán)的可行性后,通過(guò)司法社會(huì)工作介入的基本過(guò)程的實(shí)施,印證觀點(diǎn)的正確性。筆者采用個(gè)案研究的方法,研究的主要內(nèi)容是司法社會(huì)工作在老年人贍養(yǎng)權(quán)受侵害后的適用,希望通過(guò)個(gè)案研究,探索出司法社會(huì)工作的個(gè)案工作方法在處理贍養(yǎng)權(quán)等民事糾紛的經(jīng)驗(yàn),幫助法官妥善解決一些民事糾紛,維護(hù)弱勢(shì)群體利益,從而促進(jìn)矛盾糾紛的化解,維護(hù)社會(huì)的和諧穩(wěn)定。這次的個(gè)案研究是在法院的配合下,在社區(qū)工作人員的支持下進(jìn)行的,研究對(duì)象是起訴到法院的贍養(yǎng)權(quán)受侵害的老年人。這次的調(diào)查研究表明,司法社會(huì)工作在介入老年人贍養(yǎng)權(quán)保護(hù)方面能起到積極的作用。它有利于從根本上解決矛盾、化解糾紛,最終達(dá)到老年人贍養(yǎng)權(quán)得到有效保護(hù)、司法社會(huì)工作得到有效運(yùn)用,法官妥善處理矛盾三贏的局面。
[Abstract]:Nowadays, with the increase of the elderly population and aging, has brought great challenges to the society. On the one hand, the development of the economy, the intensification of conflicts, the rights of the elderly have been infringed, the other is the judicial agency for flexible management of justice on the front, in the maintenance of civil rights such intervention is not in place. Many scholars have these problems for the elderly were studied. But on the judicial intervention of social work in support of the elderly on the protection of rights is still a blank, there are many problems need to be studied and discussed. The author from the support of elderly rights infringement cases based on justice social work under the guidance of the theory, using the methods of social work -- a case in judicial work, the feasibility analysis of social work intervention to elderly support right after the judicial intervention of social work The implementation of the basic process, justify the view. The author adopts the method of case study, the main content of the study is applicable to judicial social work in support of the elderly right after the infringement, hope that through case study, find out the cases of judicial social work methods in the treatment of support right of civil dispute experience, help the judge to properly resolve some civil disputes, safeguard the interests of vulnerable groups, so as to promote and resolve disputes, maintaining social harmony and stability. This is a case study in the court under the cooperation of community staff under the support of the research object is the prosecution to the court's support right infringement investigation of the elderly. Show that the judicial social work intervention in support of the elderly rights protection actively. It is conducive to fundamentally solve the contradictions, resolve disputes, in order to support the elderly Have the right to get effective protection, effective use of judicial social work, properly handle contradictions win-win situation of judges.
