【摘要】：社區(qū)矯正兼具法治性與社會性的雙重特性。這種雙重特性使國家與社會因社區(qū)矯正實踐而相遇,由此形成以社區(qū)矯正小組、政府購買專業(yè)社區(qū)矯正服務(wù)、企業(yè)或機構(gòu)自愿承擔(dān)社會責(zé)任等為合作形式的新型治理關(guān)系。在這些關(guān)系的實踐過程中,面臨有償服務(wù)機構(gòu)的供給服務(wù)難以跟進、無償服務(wù)機構(gòu)的供給服務(wù)難以持續(xù)、社區(qū)矯正小組的執(zhí)行能力較弱等治理困境。要擺脫這種治理困境,就應(yīng)當提升社區(qū)矯正小組的執(zhí)行能力,培育專業(yè)社區(qū)矯正組織的發(fā)展并為其有效參與社區(qū)矯正工作創(chuàng)造良好的制度環(huán)境,完善社會企業(yè)參與社區(qū)矯正工作的獎勵機制,加強基層社區(qū)矯正管理服務(wù)平臺建設(shè)。
[Abstract]:Community correction has the dual characteristics of rule of law and sociality. This dual characteristic makes the country and society meet because of the practice of community correction. As a result, the community correction team and the government purchase professional community correction services. A new type of governance relationship in which enterprises or institutions voluntarily assume social responsibility and other forms of cooperation. In the practice of these relationships, it is difficult to follow up the supply and service provided by paid service organizations, and it is difficult to sustain the supply and service of unpaid service organizations. If we want to get rid of this kind of governance dilemma, we should enhance the execution ability of community correction team. To foster the development of professional community correction organizations and to create a good institutional environment for their effective participation in community correction work, to improve the incentive mechanism for social enterprises to participate in community correction work, and to strengthen the construction of grass-roots community correction management service platform.
