互聯(lián)網(wǎng)時代的智識自由與社會責(zé)任之爭——美國公共圖書館互聯(lián)網(wǎng)過濾相關(guān)法案與判例研究

摘要
本文以美國為背景,分別從相關(guān)政策法規(guī)和法院判例兩個方面對圖書館提供的互聯(lián)網(wǎng)服務(wù)所引發(fā)的社會矛盾進行研究.研究發(fā)現(xiàn),在過濾軟件的使用問題上,聯(lián)邦政府與圖書館協(xié)會的立場迥異.聯(lián)邦政府要求圖書館使用過濾軟件,而圖書館協(xié)會則持異議.對比和研究法院判例發(fā)現(xiàn),爭議主要聚焦于兩個方面:過濾軟件是否會過濾掉有用信息,對于兒童是智識自由重要還是保護兒童更重要.通過研究美國圖書館互聯(lián)網(wǎng)服務(wù)引發(fā)的爭議,可以揭示互聯(lián)網(wǎng)環(huán)境下智識自由與社會責(zé)任之間關(guān)系的復(fù)雜性,對我國圖書館界在相關(guān)問題的處理上有借鑒意義.
