文章摘要：最高人民法院對吳英非法集資案的處理,某種意義上可以視為刑事司法與社會實踐良性互動的結(jié)果,是司法對立法的適度矯正與能動反應(yīng)。對于民間金融,我國現(xiàn)行法律主要是通過禁止非法集資來對其進(jìn)行規(guī)范的。不過,一方面由于規(guī)范表達(dá)的＂過度涵攝＂而難免導(dǎo)致官方的監(jiān)管無力,另一方面由于其沒能尊重真實社會的具體訴求而使之淪為無人信仰的法律,以致最終導(dǎo)致陷入監(jiān)管困局,這有力地說明立法表達(dá)必須尊重真實世界的社會實踐。實際上,減少或消解非法集資及其所導(dǎo)致的社會問題的根本出路在于改革現(xiàn)有僵化的金融體制,對民間金融進(jìn)行理性引導(dǎo),逐步推進(jìn)民間金融利率的市場化和合理化,使之步入法治化的軌道。這也是當(dāng)前我國在極不利的國內(nèi)外經(jīng)濟(jì)形勢下保證經(jīng)濟(jì)持續(xù)增長的重要途徑。

Abstr：In a sense,the conclusion on Wu Ying illegal fund-raising case of the Supreme People＇s Court can be regarded as an optimum interaction between criminal justice and social practice and as an appropriate adjusting to current legislation in criminal justice process.The regulations in our country forbids Non-Governmental finance from the opposite by attacking illegal fund-raising.However,on the one hand,the over-inclusive phenomena of the regulations makes the government＇s supervisions of no avail.On the other hand,owing to the regulations＇ ignorance of the social demands,peoples are willing to break the law.This seriously brings about the supervisions to the inconvenient dilemma.In fact,the fundamental measures reducing the social problems of illegal fund-raising are reforming current rigid financial system and guiding Non-Governmental finance into the legitimate rail and making it marketization.
