【摘要】：煤炭行業(yè)是我國(guó)經(jīng)濟(jì)發(fā)展的基礎(chǔ)性行業(yè)之一,在能源領(lǐng)域占據(jù)著重要的地位,煤礦企業(yè)的發(fā)展為我國(guó)經(jīng)濟(jì)建設(shè)提供了雄厚的保障。長(zhǎng)期以來,各級(jí)管理機(jī)構(gòu)對(duì)煤礦企業(yè)的監(jiān)管不夠嚴(yán)格,安全生產(chǎn)投入資本偏低、執(zhí)行國(guó)家煤礦安全生產(chǎn)管理法律法規(guī)不到位,導(dǎo)致煤礦安全生產(chǎn)事故控制難,礦難頻發(fā),煤礦工人傷亡人數(shù)呈逐年上升趨勢(shì),工人的生命權(quán)、健康權(quán)沒有得到更好的保護(hù)。煤礦工人的管理固化、勞動(dòng)環(huán)境惡劣、工資報(bào)酬偏低。致使煤礦工人的生活水平偏低,侵害了煤礦工人的勞動(dòng)權(quán)、工傷保險(xiǎn)、失業(yè)保險(xiǎn)、醫(yī)療保險(xiǎn)參保率低、保障待遇不足,使煤礦工人的社會(huì)保障權(quán)沒有得到更好的保護(hù)等等。煤礦工人是煤炭行業(yè)的就業(yè)主體,他們的安全保障受到威脅,社會(huì)地位和經(jīng)濟(jì)收入相對(duì)較低,在經(jīng)濟(jì)飛速發(fā)展的今天,逐漸成為社會(huì)上的弱勢(shì)群體,關(guān)注煤礦工人的生存生活狀況,既是對(duì)煤礦工人的關(guān)懷,又是國(guó)家各項(xiàng)惠民政策落實(shí)的有效手段,既維護(hù)了煤炭企業(yè)工人的合法權(quán)益,又保障了煤炭行業(yè)的發(fā)展前景,促進(jìn)煤炭行業(yè)乃至國(guó)民經(jīng)濟(jì)的健康穩(wěn)定發(fā)展。本文針對(duì)煤炭工人的特殊性,研究了煤礦工人權(quán)益的法律保護(hù)。采用多種方式,分析研究了煤礦工人的勞動(dòng)權(quán)、民事權(quán)、社會(huì)保障權(quán)和司法救濟(jì)的基本狀況;客觀剖析了明確煤礦工人權(quán)益法律保護(hù)存在的主要問題和內(nèi)在原因;結(jié)合我國(guó)依法治國(guó)戰(zhàn)略的實(shí)施,科學(xué)、客觀地提出了煤礦工人合法權(quán)益法律保護(hù)的策略性建議。因此,要從嚴(yán)落實(shí)國(guó)家的安全生產(chǎn)法律法規(guī),從政府管理、司法立法、執(zhí)法等層面,加強(qiáng)對(duì)煤礦企業(yè)生產(chǎn)、經(jīng)營(yíng)、用工、保障等環(huán)節(jié)的監(jiān)督和管理,落實(shí)企業(yè)安全生產(chǎn)主體責(zé)任,強(qiáng)化煤礦企業(yè)勞動(dòng)用工管理,保障煤礦工人的社會(huì)保障待遇、加大對(duì)煤礦工人權(quán)益的行政與司法救濟(jì),在促進(jìn)煤礦企業(yè)健康發(fā)展,增加經(jīng)營(yíng)利潤(rùn)的同時(shí),把煤礦工人的合法權(quán)益納入法律保護(hù)的范疇,通過立法將煤礦工人應(yīng)享有的權(quán)益,都能夠在煤礦企業(yè)的生產(chǎn)經(jīng)營(yíng)過程中得到保障,使煤礦工人享有與城鄉(xiāng)居民同等的權(quán)益和待遇,減少社會(huì)對(duì)煤礦工人的歧視。
[Abstract]:The coal industry is one of the basic industries in China's economic development, which occupies an important position in the field of energy. The development of coal mining enterprises provides a strong guarantee for the economic construction of our country. For a long time, the supervision of coal mining enterprises at all levels has not been strict enough, the investment capital for safety production is on the low side, and the implementation of the national laws and regulations on coal mine safety production management is not in place, which leads to the difficulty of controlling coal mine safety production accidents and the frequent occurrence of mine accidents. The number of coal mine workers has been increasing year by year, and the right to life and health have not been better protected. The management of coal mine workers solidified, the working environment is bad, the salary reward is on the low side. As a result, the living standard of coal miners is on the low side, which infringes on the coal miners' labor rights, industrial injury insurance, unemployment insurance, medical insurance participation rate, inadequate security treatment, so that the coal miners' social security rights have not been better protected and so on. Coal miners are the main body of employment in the coal industry. Their safety and security are threatened, and their social status and economic income are relatively low. With the rapid economic development today, coal miners have gradually become a vulnerable group in the society. Paying attention to the survival and living conditions of coal miners is not only the concern for coal miners, but also an effective means for the implementation of various national policies benefiting the people. It not only preserves the legitimate rights and interests of workers in coal enterprises, but also guarantees the development prospects of the coal industry. To promote the healthy and stable development of the coal industry and even the national economy. According to the particularity of coal workers, this paper studies the legal protection of coal miners' rights and interests. In this paper, the author analyzes and studies the basic conditions of labor right, civil right, social security right and judicial relief of coal miners in various ways, and objectively analyzes the main problems and internal reasons for the legal protection of the rights and interests of coal miners. Combined with the implementation of the strategy of governing the country according to law, this paper puts forward some strategic suggestions for the legal protection of the legal rights and interests of coal miners. Therefore, it is necessary to strictly implement the national laws and regulations on production safety, strengthen the supervision and management of the production, operation, employment and security of coal mining enterprises from the levels of government management, judicial legislation, law enforcement, etc. In order to promote the healthy development of coal mining enterprises, it is necessary to implement the responsibility of the main body responsible for the safety of production in enterprises, strengthen the management of labor and employment in coal mining enterprises, guarantee the social security treatment of coal miners, increase administrative and judicial relief to the rights and interests of coal miners, and promote the healthy development of coal mines. While increasing operating profits, the legitimate rights and interests of coal miners can be brought into the scope of legal protection, and the rights and interests that coal miners should enjoy through legislation can be protected in the production and operation process of coal mining enterprises. Coal miners enjoy the same rights and benefits as urban and rural residents and reduce social discrimination against coal miners.
