【摘要】：農(nóng)民住房財產(chǎn)權(quán)是經(jīng)濟法研究的重點課題之一,該財產(chǎn)權(quán)沒有被法律賦予與城鎮(zhèn)房屋產(chǎn)權(quán)同等的價值,這在立法、司法、學術(shù)領域都引起了極大的爭議。在黨的十七大報告中首次提出“創(chuàng)造條件讓更多農(nóng)民獲得財產(chǎn)性收入”,同時在最近召開的十八屆三中全會上又提出了“慎重穩(wěn)妥推進農(nóng)民住房財產(chǎn)權(quán)抵押擔保轉(zhuǎn)讓”,從而“賦予農(nóng)民更多財產(chǎn)性權(quán)利”。然而,這僅僅是在政策上對農(nóng)民住房流轉(zhuǎn)有所放松,而關于農(nóng)民住房財產(chǎn)權(quán)的相關法律尚未成形,且現(xiàn)行有關法律似與之有所相悖。完善農(nóng)民住房財產(chǎn)權(quán)法律制度有利于我國順應法制建設的潮流,符合城鄉(xiāng)統(tǒng)籌發(fā)展的現(xiàn)實,構(gòu)建農(nóng)村住房財產(chǎn)權(quán)的法律體系,制定一套行之有效的農(nóng)村住房財產(chǎn)權(quán)制度,也有利于我國特色社會主義法治道路和城鄉(xiāng)統(tǒng)籌發(fā)展。筆者在認真研讀現(xiàn)行法律的基礎上,采取多學科交叉研究和實證研究方法對農(nóng)民住房財產(chǎn)權(quán)的內(nèi)涵、外延進行了法理分析,對住房財產(chǎn)權(quán)現(xiàn)狀進行了梳理,對農(nóng)民住房財產(chǎn)權(quán)中重要組成部分---宅基地的流轉(zhuǎn)進行了必要性和合理性的分析,并針對農(nóng)民住房法律制度現(xiàn)狀分別從權(quán)屬管理、法律法規(guī)、政策導向、社保體系四個角度提出了完善農(nóng)民住房財產(chǎn)權(quán)法律制度的對策,試圖對完善農(nóng)民住房財產(chǎn)權(quán)的法律制度提供選擇方案,以期對其有所貢獻。
[Abstract]:The farmer's housing property right is one of the key topics in the economic law research. The property right has not been given the same value as the urban house property right by law, which has caused great controversy in the field of legislation, judicature and academic field. In the report of the 17th National Congress of the CPC, it was proposed for the first time "to create conditions for more farmers to obtain property income." at the recent third Plenary session of the 18th CPC Central Committee, they also proposed "prudently and steadily promoting the mortgage guarantee transfer of peasants' housing property rights." Thus, "give farmers more property rights." However, this is only a policy to relax the circulation of farmers' housing, and the relevant laws on the farmers' housing property rights have not yet taken shape, and the existing laws seem to be contrary to them. Perfecting the legal system of farmers' housing property rights is helpful for our country to conform to the trend of legal construction, conform to the reality of the overall development of urban and rural areas, construct the legal system of rural housing property rights, and formulate a set of effective rural housing property rights system. Also conducive to socialist rule of law with Chinese characteristics and urban and rural development as a whole. On the basis of studying the current law, the author analyzes the connotation and extension of the farmer's housing property right by means of multi-disciplinary cross-research and empirical research, and combs the present situation of the housing property right. This paper analyzes the necessity and rationality of the circulation of the homestead, which is an important part of the farmer's housing property right, and aims at the present situation of the legal system of the farmer's housing from the ownership management, the laws and regulations, the policy direction, respectively. This paper puts forward the countermeasures of perfecting the legal system of peasants' housing property right from four angles of social security system, and tries to provide the alternative scheme for perfecting the legal system of peasants' housing property right, in order to contribute to it.
