【摘要】：農(nóng)村土地流轉(zhuǎn)是備受社會(huì)關(guān)注的熱點(diǎn)問(wèn)題,也是近幾年中央涉農(nóng)文件中頻繁出現(xiàn)的關(guān)鍵詞。在舉國(guó)推進(jìn)新型城鎮(zhèn)化的浪潮中,現(xiàn)代農(nóng)業(yè)如何發(fā)展,美麗鄉(xiāng)村如何建設(shè),城鎮(zhèn)用地如何保障,這些都難以繞開(kāi)土地流轉(zhuǎn)問(wèn)題,進(jìn)而考驗(yàn)著各級(jí)政府的智慧。適逢國(guó)家在大力推進(jìn)農(nóng)村綜合改革,國(guó)土資源部也同時(shí)開(kāi)展土地制度改革試點(diǎn)之機(jī),開(kāi)展農(nóng)村土地流轉(zhuǎn)研究具有理論和實(shí)踐雙重意義。本文綜合運(yùn)用了文獻(xiàn)研究法、經(jīng)驗(yàn)總結(jié)法、問(wèn)卷調(diào)查法等多種手段,在參考國(guó)內(nèi)外相關(guān)文獻(xiàn)的基礎(chǔ)上,結(jié)合當(dāng)前我國(guó)土地流轉(zhuǎn)實(shí)踐,重點(diǎn)剖析了山東省金鄉(xiāng)縣土地流轉(zhuǎn)案例,概括了該縣農(nóng)村土地流轉(zhuǎn)中存在的突出問(wèn)題,并就其成因進(jìn)行了深入探討。同時(shí)立足山東,放眼全國(guó),借鑒國(guó)內(nèi)其它省市先進(jìn)經(jīng)驗(yàn)和做法,結(jié)合本人的深刻思考,提出了關(guān)于加快土地流轉(zhuǎn)的系列對(duì)策建議,對(duì)國(guó)內(nèi)其它農(nóng)業(yè)縣土地流轉(zhuǎn)也提供某些參考。第一章為緒論篇。結(jié)合國(guó)家政策形勢(shì),闡述了研究背景、研究目的和研究意義,并對(duì)當(dāng)前該領(lǐng)域國(guó)內(nèi)外研究進(jìn)展情況進(jìn)行了綜述,闡明了研究思路、研究方法、創(chuàng)新點(diǎn)及不足等。第二章為理論篇。闡述了土地流轉(zhuǎn)的有關(guān)概念、理論、政策和法律法規(guī),概括了我國(guó)土地流轉(zhuǎn)制度發(fā)展演變的三個(gè)歷程,創(chuàng)造性地提出了土地流轉(zhuǎn)類(lèi)型劃分新標(biāo)準(zhǔn),并據(jù)此將之分為農(nóng)業(yè)用地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)、集體建設(shè)用地使用權(quán)流轉(zhuǎn)和集體建設(shè)用地發(fā)展權(quán)三大類(lèi)型。第三章為實(shí)踐篇。通過(guò)問(wèn)卷和訪談等形式,調(diào)查了山東省金鄉(xiāng)縣的土地流轉(zhuǎn)情況,分析了當(dāng)前土地流轉(zhuǎn)普遍存在的共性問(wèn)題及原因,系統(tǒng)總結(jié)了行之有效的經(jīng)驗(yàn)和做法。第四章為對(duì)策篇。針對(duì)上述問(wèn)題提出了六條對(duì)策建議,即加快土地確權(quán)、創(chuàng)新流轉(zhuǎn)方式、完善服務(wù)體系、強(qiáng)化政策引導(dǎo)、加強(qiáng)社會(huì)保障、健全法律法規(guī)。希望本文能為各地土地流轉(zhuǎn)工作提供借鑒和參考,以此促進(jìn)我國(guó)農(nóng)村土地流轉(zhuǎn)高效推進(jìn),農(nóng)業(yè)規(guī)�；�(jīng)營(yíng)健康發(fā)展,農(nóng)民財(cái)產(chǎn)性收益持續(xù)增加。
[Abstract]:Rural land circulation is a hot issue of social concern, and it is also the key word frequently appeared in the central agricultural documents in recent years. In the tide of promoting new urbanization in the whole country, how to develop modern agriculture, how to build beautiful countryside and how to guarantee urban land are difficult to circumvent the problem of land circulation, and then test the wisdom of governments at all levels. At the same time, the Ministry of Land and Resources also has the opportunity to carry out the pilot project of land system reform. It is of both theoretical and practical significance to carry out the research on rural land circulation. This article synthetically uses the literature research method, the experience summary method, the questionnaire survey method and so on, in the reference domestic and foreign related literature foundation, unifies the present our country land circulation practice, has analyzed the Shandong Province Jinxiang county land circulation case emphatically, This paper summarizes the outstanding problems existing in the rural land circulation in this county, and probes into the causes. At the same time, based on Shandong, looking at the whole country, drawing lessons from the advanced experiences and practices of other provinces and cities in China, combining with my profound thinking, this paper puts forward a series of countermeasures and suggestions on speeding up the land circulation, which provides some references for the land circulation of other agricultural counties in China. The first chapter is the introduction. Combined with the situation of national policy, this paper expounds the background, purpose and significance of the research, and summarizes the research progress in this field at home and abroad, and clarifies the research ideas, research methods, innovation points and shortcomings, etc. The second chapter is the theory. This paper expounds the related concepts, theories, policies and laws and regulations of land circulation, summarizes the three processes of the development and evolution of the land circulation system in China, and creatively puts forward new standards for the classification of land circulation types. According to this, it can be divided into three types: the right to contract management of agricultural land, the right to use collective construction land and the right to development of collective construction land. The third chapter is the practice chapter. By means of questionnaire and interview, this paper investigates the situation of land circulation in Jinxiang County, Shandong Province, analyzes the common problems and causes of current land circulation, and systematically summarizes the effective experience and practice. The fourth chapter is the countermeasures. In view of the above problems, this paper puts forward six countermeasures and suggestions, that is, speeding up the confirmation of land rights, innovating the circulation mode, perfecting the service system, strengthening policy guidance, strengthening social security, and perfecting laws and regulations. I hope this paper can provide reference and reference for the work of land circulation in various places, so as to promote the efficient promotion of rural land circulation in China, the healthy development of large-scale agricultural management, and the continuous increase of property income of farmers.
