【摘要】：伴隨著現(xiàn)代社會中對于生存質(zhì)量要求的提高,以及人們物質(zhì)生活條件改善后對于生死觀念的轉(zhuǎn)變,安樂死作為已無治愈可能、處于瀕危狀態(tài)的患者自主選擇提前結(jié)束生命的一種方式,逐漸被社會所認(rèn)知。目前世界上已經(jīng)有部分國家或地區(qū)在法律上和醫(yī)學(xué)上許可了安樂死的存在,但為了規(guī)避可能的倫理和法律風(fēng)險(xiǎn),安樂死的執(zhí)行條件都非常嚴(yán)格。由于我國受傳統(tǒng)文化影響頗深,醫(yī)療條件和社會保障制度處于較低水平,并且法制建設(shè)進(jìn)程緩慢,所以對安樂死的研究一直停留在理論層面,實(shí)踐層面的研究更是舉步維艱。因此,本文試圖從倫理學(xué)角度論證安樂死在我國實(shí)施的可行性。本篇論文采用文獻(xiàn)研究法和比較法,客觀詳實(shí)的分析了倫理學(xué)視角下安樂死問題。文章首先介紹了倫理學(xué)視角下安樂死問題的選題目的和選題意義,分析歸納了關(guān)于本選題的國內(nèi)外研究現(xiàn)狀,概括了本文主要研究方法并提出了本文的理論創(chuàng)新點(diǎn)。其次,系統(tǒng)闡述了安樂死的界定和分類,從不同角度將安樂死分為積極安樂死與消極安樂死、自愿安樂死與非自愿安樂死。并且對安樂死國內(nèi)外發(fā)展概況進(jìn)行了系統(tǒng)的分析。然后,重點(diǎn)分析了當(dāng)前我國實(shí)行安樂死的倫理困境,從生命倫理、醫(yī)學(xué)倫理和家庭倫理三個(gè)層面展開分析:生命倫理困境主要表現(xiàn)在傳統(tǒng)生死觀與安樂死沖突,本質(zhì)是生命神圣論與生命質(zhì)量論之爭;醫(yī)學(xué)倫理困境體現(xiàn)在傳統(tǒng)醫(yī)學(xué)理念與安樂死的沖突,實(shí)質(zhì)是理論與實(shí)踐的脫離;家庭倫理困境主要體現(xiàn)在傳統(tǒng)家庭倫理與安樂死的沖突,表現(xiàn)在情感與理性的對立。最后,針對上述問題,提出了我國實(shí)行安樂死的倫理出路,其中著重強(qiáng)調(diào)確立安樂死的倫理原則,包括人道主義、有利無害、自主尊重和公平公正原則,同時(shí)要構(gòu)建實(shí)施安樂死的制度保障,即制定安樂死法律法規(guī),確立安樂死實(shí)施標(biāo)準(zhǔn),規(guī)范安樂死實(shí)施程序,并以此為基點(diǎn),進(jìn)一步提升安樂死參與者的道德素養(yǎng),不僅要規(guī)范安樂死參與者的道德行為,還要樹立安樂死參與者的道德良心觀,以期最終實(shí)現(xiàn)安樂死在我國得以實(shí)施的目的。
[Abstract]:With the improvement of the quality of life in modern society and the change of people's concept of life and death after the improvement of material living conditions, euthanasia is no longer possible to cure. Patients in endangered state choose a way to end their life ahead of time, which is gradually recognized by society. At present, some countries or regions in the world have permitted the existence of euthanasia in law and medicine, but in order to avoid the possible ethical and legal risks, euthanasia execution conditions are very strict. Because of the deep influence of traditional culture, the low level of medical condition and social security system, and the slow process of legal system construction, the research on euthanasia has always remained at the theoretical level, and the research on the practical level is even more difficult. Therefore, this paper tries to demonstrate the feasibility of euthanasia in China from the perspective of ethics. This paper analyzes euthanasia from the perspective of ethics by literature research and comparative method. This paper first introduces the purpose and significance of the topic of euthanasia from the perspective of ethics, analyzes and summarizes the domestic and foreign research status of this topic, summarizes the main research methods of this paper and puts forward the theoretical innovation of this paper. Secondly, the definition and classification of euthanasia are systematically expounded, which are divided into active euthanasia and negative euthanasia, voluntary euthanasia and involuntary euthanasia from different angles. And the development of euthanasia at home and abroad is systematically analyzed. Then, it analyzes the ethical dilemma of euthanasia in our country, and analyzes it from the aspects of bioethics, medical ethics and family ethics: the dilemma of bioethics is mainly manifested in the conflict between the traditional view of life and death and euthanasia. The essence is the dispute between the theory of life sacredness and the theory of quality of life; the dilemma of medical ethics is embodied in the conflict between traditional medical idea and euthanasia, the essence is the separation of theory and practice, and the dilemma of family ethics is mainly reflected in the conflict between traditional family ethics and euthanasia. It is manifested in the opposition between emotion and reason. Finally, in view of the above problems, the author puts forward the ethical way out of euthanasia in our country, which emphasizes the establishment of the ethical principles of euthanasia, including the principles of humanitarianism, benefit and harmlessness, autonomy respect and fairness and justice, At the same time, it is necessary to construct the system guarantee of euthanasia, that is, to establish the laws and regulations of euthanasia, to establish the standards of euthanasia, to standardize the procedures of euthanasia, and to further enhance the moral literacy of the participants in euthanasia. Not only to regulate the moral behavior of euthanasia participants, but also to establish the moral conscience of euthanasia participants in order to achieve the goal of euthanasia in China.
