成都市土地流轉(zhuǎn)模式中農(nóng)民權(quán)益保障的專題研究

【摘要】:隨著國家經(jīng)濟不斷發(fā)展,城市化和工業(yè)化的快速推進(jìn),農(nóng)村勞動力外出務(wù)工的增多和現(xiàn)代農(nóng)業(yè)的發(fā)展,土地流轉(zhuǎn)有利于提高土地資源的利用效益,加快發(fā)展農(nóng)業(yè)現(xiàn)代化的進(jìn)程,實現(xiàn)轉(zhuǎn)移勞動力和增收等優(yōu)勢將進(jìn)一步凸顯。2008、2009兩年中央一號文件,十七屆三中全會等對農(nóng)村土地流轉(zhuǎn)均作出規(guī)定,體現(xiàn)了黨中央對農(nóng)民合法權(quán)益的保障與維護(hù)。但是,也還存在著部分地區(qū),在鎮(zhèn)村的統(tǒng)一組織調(diào)整下,對農(nóng)民以非政策引導(dǎo)的方式,用行政干預(yù)代替了農(nóng)民的自愿選擇,農(nóng)民對自身土地流轉(zhuǎn)茫然無知,土地被流轉(zhuǎn)后生活難以為繼、政府與民爭利等等,農(nóng)民利益保障問題的復(fù)雜性已逐漸突顯。受所在單位委托,筆者將立足于在土地流轉(zhuǎn)中對農(nóng)民權(quán)益進(jìn)行有效保障而開展研究。中共十七大報告中首次指出,要為人民群眾的財產(chǎn)性收入創(chuàng)造更多的條件。隨后,黨的十七屆三中全會也為推進(jìn)農(nóng)村改革發(fā)展出臺了一系列規(guī)定,這些都表明了農(nóng)村土地流轉(zhuǎn)在我國新農(nóng)村建設(shè)中的重要性。然而,受農(nóng)村土地制度及農(nóng)民自身、政府等因素的影響,農(nóng)村土地流轉(zhuǎn)過程中出現(xiàn)補償水平低或不均衡、違規(guī)執(zhí)行、租金不符合實際情況,官民關(guān)系惡化等系列問題。如:農(nóng)民合法權(quán)益受到損失或者失地后就業(yè)難,成為“無地、無業(yè)、無社!钡摹叭裏o”農(nóng)民不斷上訪,和政府等其他機構(gòu)關(guān)系惡化的事件也有很多。這些情況都對我國的社會發(fā)展及和諧新農(nóng)村建設(shè)造成了隱性的威脅,阻礙了農(nóng)村發(fā)展。因此,系統(tǒng)的研究農(nóng)村土地流轉(zhuǎn)中農(nóng)民權(quán)益保障問題,探討怎樣建立完善我國農(nóng)村土地流轉(zhuǎn)制度,保障農(nóng)民權(quán)益,構(gòu)建有效機制,對維護(hù)社會穩(wěn)定和國家長治久安具有重大的意義。本文以分析錦江區(qū)三圣鄉(xiāng)紅砂村模式、邛崍“湯營模式”、龍泉驛區(qū)大蘭山生態(tài)移民模式、雙流昆山都市農(nóng)業(yè)園區(qū)模式、龍泉驛區(qū)書房村模式,金堂縣三星鎮(zhèn)“雙放棄雙流轉(zhuǎn)三轉(zhuǎn)移”整鎮(zhèn)推進(jìn)農(nóng)民下山進(jìn)城入鎮(zhèn)模式對幾種典型方式的綜合實踐,總結(jié)經(jīng)驗得到啟示,從探索機制體系、完善服務(wù)等方面提出一些對策措施,以解決土地承包經(jīng)營權(quán)流轉(zhuǎn)中農(nóng)民利益的保障問題。其創(chuàng)新之處在于通過對成都相關(guān)問題的分析,特別是幾個頗為典型的案例的分析,以新公共管理理論作為工具,綜合成功經(jīng)驗,在實踐中總結(jié)經(jīng)驗并將經(jīng)驗帶入實踐進(jìn)行證明,促使理論在實踐中得以完善。
[Abstract]:With the continuous development of national economy, the rapid development of urbanization and industrialization, the increase of rural labor force and the development of modern agriculture, land circulation is conducive to improving the utilization efficiency of land resources and speeding up the process of agricultural modernization. Realizing the advantages of transferring labor force and increasing income will further highlight the No. 1 document of the Central Committee in 2009 and the third Plenary session of the 17th CPC Central Committee, which provides for the circulation of rural land, which reflects the protection and maintenance of the Party Central Committee's legitimate rights and interests of farmers. However, there are still some areas. Under the unified organization and adjustment of towns and villages, administrative intervention has replaced the voluntary choice of farmers with non-policy guidance, and peasants are ignorant of their own land circulation. After land is transferred, life is difficult to continue, government and people compete for interests and so on, the complexity of farmers' interests protection has gradually become more and more obvious. Entrusted by the unit, the author will carry out research based on the effective protection of farmers' rights and interests in the land circulation. The report of the 17th National Congress of the Communist Party of China pointed out for the first time that more conditions should be created for the property income of the masses. Subsequently, the third Plenary session of the 17th CPC Central Committee also issued a series of regulations for the promotion of rural reform and development, which shows the importance of rural land transfer in the new rural construction of our country. However, under the influence of rural land system, farmers themselves, government and other factors, there are a series of problems in the process of rural land circulation, such as low or unbalanced compensation level, illegal implementation, rent not in line with the actual situation, deterioration of the relationship between the government and the people, and so on. For example: farmers' legitimate rights and interests are lost or it is difficult to find employment after losing land, so there are a lot of incidents of "no land, no employment, no social security" for farmers who keep petitioning, and deteriorating relations with other institutions such as the government. These conditions have caused recessive threat to the social development and harmonious new rural construction of our country and hindered the rural development. Therefore, this paper systematically studies the protection of farmers' rights and interests in the circulation of rural land, and probes into how to establish and perfect the system of rural land circulation in China, to protect the rights and interests of farmers, and to build an effective mechanism. It is of great significance to the maintenance of social stability and the long-term stability of the country. This paper analyzes the red sand village model in Sanshen Township, Jinjiang District, Qionglai "Tang Ying Mode", the Dalanshan Ecological Migration Model in Longquanyi District, the Shuangliu Kunshan Urban Agricultural Park Model, the Shuangquanyi District Shufangcun Village Model, In Sanxing Town, Jintang County, "double giving up double flow to three transfer", the whole town pushes farmers down the mountain into town to enter the town comprehensive practice to several typical ways, summarizes experience to get enlightenment, and puts forward some countermeasures and measures from exploring mechanism system, perfecting service and so on. In order to solve the issue of protection of farmers' interests in the transfer of land contractual management rights. The innovation lies in the analysis of the relevant problems in Chengdu, especially the analysis of several typical cases. The new public management theory is used as a tool to synthesize the successful experience, to sum up the experience in practice and to bring the experience into practice to prove it.
