【摘要】：作為社會保障制度重要的理論依據(jù),社會保障權(quán)有其獨特的演進脈絡(luò)。從社會救助權(quán)與社會保障權(quán)憲法規(guī)范的確立到福利國家的普遍建立與發(fā)展,從社會保障權(quán)因自身結(jié)構(gòu)缺陷與外在挑戰(zhàn)而面臨消解性危機到不同理論流派引領(lǐng)的社會保障權(quán)重構(gòu)之路,社會保障權(quán)經(jīng)歷了產(chǎn)生、發(fā)展、消解與重構(gòu)的過程。社會保障權(quán)的歷史演變?yōu)橹袊鐣Ｕ蠙?quán)建設(shè)提供的啟示是中國社會保障權(quán)要回歸公民身份,發(fā)揮各主體積極性并體現(xiàn)共生思想。
[Abstract]:As an important theoretical basis of social security system, the right to social security has its unique evolution. From the establishment of the constitutional norms of the right to social assistance and the right of social security to the universal establishment and development of the welfare state, From the dissolving crisis of the right to social security due to its own structural defects and external challenges to the reconstruction of the right to social security guided by different theoretical schools, the right to social security has experienced the process of emergence, development, resolution and reconstruction. The historical evolution of the right to social security provides enlightenment for the construction of the right to social security in China, which is that the right to social security should return to its citizenship, give play to the initiative of all subjects and embody the idea of symbiosis.
