【摘要】:黨的十八大報告指出,“積極應(yīng)對人口老齡化,大力發(fā)展老齡服務(wù)事業(yè)和產(chǎn)業(yè)。”“健全社會保障經(jīng)辦管理體制,建立更加便民快捷的服務(wù)體系。”2013年李克強總理在國務(wù)院常務(wù)會議上提出,“要加快發(fā)展健康養(yǎng)老服務(wù)。加強醫(yī)療衛(wèi)生支撐,建立健全醫(yī)療機構(gòu)和老年護理院、康復(fù)療養(yǎng)等養(yǎng)老機構(gòu)的轉(zhuǎn)診與合作機制。發(fā)展社區(qū)、農(nóng)村健康養(yǎng)老服務(wù)。”可見,黨和國家對民辦養(yǎng)老事業(yè)的發(fā)展給予厚望,為其提供便利政策和有利條件,不斷壯大其發(fā)展,成為未來養(yǎng)老服務(wù)市場的中流砥柱,為廣大老年人帶來更多實惠好處。目前我國60歲以上的老年人超過2億,預(yù)計到2020年,我國老年人口將達到2.48億。我國是世界上典型的老齡化國家,不同于其他老齡化國家,我國養(yǎng)老模式是以家庭養(yǎng)老為主,但是隨著老年人口的激增,家庭結(jié)構(gòu)的嬗變,中青年人贍養(yǎng)老人的壓力與日俱增,社會養(yǎng)老服務(wù)市場破繭而出,市場的自由競爭性質(zhì)孕育了民辦養(yǎng)老事業(yè)的興起,它很大程度上緩解了公立養(yǎng)老機構(gòu)床位不足、費用過高等的窘境。本文首先對民辦養(yǎng)老事業(yè)行政法保障相關(guān)的理論問題進行了闡述,具體包括民辦養(yǎng)老事業(yè)的法律性質(zhì)和社會意義,理論鋪墊主要有人權(quán)保障、新公共服務(wù)、福利多元理論,以及行政法保障事業(yè)的必要意義。對相關(guān)理論問題進行闡述的基礎(chǔ)上,介紹了國外一些國家對民辦養(yǎng)老事業(yè)保障的相關(guān)行政立法,例如美國、英國、日本,這些發(fā)達國家在養(yǎng)老保障和養(yǎng)老立法方面突出的優(yōu)秀經(jīng)驗令人贊嘆,對他們的民辦養(yǎng)老事業(yè)的行政法保障的特色進行了總結(jié),從而為我國民辦養(yǎng)老事業(yè)的行政法保障提供了較為成熟的理論與具體法律制度的啟示。本文還對目前我國民辦養(yǎng)老事業(yè)的行政法保障的現(xiàn)狀進行歸納概括,指出行政法保障的現(xiàn)存突出重點問題,這些問題主要有民辦養(yǎng)老事業(yè)準入制度籠統(tǒng)殘缺,政府在民辦養(yǎng)老事業(yè)運行中監(jiān)管評估職能履行不到位,服務(wù)過程中行政法對于服務(wù)糾紛解決的保障缺失,行政法保障模式發(fā)展僵化。問題的出現(xiàn)意味著解決措施的開展,文章的最后在總結(jié)問題的基礎(chǔ)上提出了完善民辦養(yǎng)老事業(yè)行政法保障的一些措施,一是進一步完善民辦養(yǎng)老事業(yè)準入制度,如完善立法體系、細化準入規(guī)則;二是優(yōu)化民辦養(yǎng)老事業(yè)的運行監(jiān)管評估職能,如、建立養(yǎng)老機構(gòu)基本信息檔案制度、建立第三方評估機制、打造養(yǎng)老護理人員培訓(xùn)體系、建立養(yǎng)護人員優(yōu)遇制度等相關(guān)制度的建立。三是完善民辦養(yǎng)老事業(yè)服務(wù)糾紛的行政法保障,如民政部印發(fā)養(yǎng)老服務(wù)合同范本,制定養(yǎng)老機構(gòu)傷害事故處理辦法,明確歸責原則;四是創(chuàng)造性地提出行政法保障民辦養(yǎng)老事業(yè)發(fā)展的新型模式,改變以往僵化的保障模式。國家和政府大力支持鼓勵社會資本引入、政府購買公共服務(wù)、設(shè)立行業(yè)協(xié)會的方式創(chuàng)新民辦養(yǎng)老事業(yè)的行政法保障。

China is a typical aging country in the world, different from other aging countries, our pension model is based on family pension, but with the elderly population The growth of the family structure, the growth of the family structure, the increasing pressure of the young people to support the elderly, the emergence of the social service market for the aged, the free competition of the market has nurtured the rise of the private pension undertakings, which greatly alleviated the embarrassment of insufficient beds and high cost of the public pension institutions. This paper expounds the relevant theoretical problems, including the legal nature and social significance of the private pension undertakings. The theoretical paving mainly includes the protection of human rights, the new public service, the theory of welfare pluralism, and the necessary significance of the administrative law guarantee. On the basis of the relevant theoretical problems, some foreign countries are introduced to the people. The relevant administrative legislation, such as the United States, the United Kingdom, Japan, and the outstanding experiences of the developed countries in the old-age security and pension legislation are exclamatory, and the characteristics of the administrative law guarantee of their private pension undertakings are summarized, so as to provide the more of the administrative law guarantee for the national endowment. The present situation of the administrative law guarantee of the private pension in China is summarized and summarized, and the outstanding key problems of the administrative law guarantee are pointed out. These problems mainly include the incomplete access system of the private pension cause and the government supervision and evaluation in the run of the private pension. It can not be fulfilled, the administrative law in the service process is lacking in the guarantee of the service dispute settlement, the development of the administrative law guarantee mode is rigid. The problem is the development of the solution measures.
