溫州市工會組織維護農(nóng)民工合法權益問題研究

【摘要】:隨著現(xiàn)代生產(chǎn)力的發(fā)展,農(nóng)民工作為中國城市化進程中特有的勞動力群體,是產(chǎn)業(yè)工人的重要組成部分,是經(jīng)濟建設中的中流砥柱,但由于現(xiàn)行的社會政策和制度尚有缺陷,農(nóng)民工的合法權益未能得以有效實現(xiàn)。工會組織肩負著維權的重要職責,維護農(nóng)民工權益是工會維權工作的重要內容。當前,工會在維護農(nóng)民工權益中仍存在著各類問題,從而影響了工會維權的實效。溫州作為非公有制發(fā)達且占主要地位的城市,集聚了大量的農(nóng)民工,是權益受侵害的高發(fā)地。近幾年受經(jīng)濟下行的大環(huán)境影響,溫州正面臨穩(wěn)增長與調結構的雙重壓力,企業(yè)發(fā)展遭遇瓶頸期,老板跑路企業(yè)倒閉現(xiàn)象層出不窮,帶來勞動爭議頻發(fā),農(nóng)民工權益問題日益嚴峻化。本研究正是基于上述背景下,從溫州工會系統(tǒng)對農(nóng)民工的權益保障問題角度出發(fā),進行實證分析,運用文獻查閱法、問卷調查法等進行研究。在對比國外城鄉(xiāng)勞動力流動的狀況和工會維護勞動者權益的基礎上,結合溫州市農(nóng)民工權益缺失的現(xiàn)狀和工會系統(tǒng)保障農(nóng)民工權益的主要做法,通過重點分析溫州市工會系統(tǒng)在維護農(nóng)民工勞動權益、社會保障權益、政治權益、文化生活教育權益等各方面遇到的問題。同時,在分析問題的基礎上,歸納了其相關的原因,包括法律法規(guī)和維權機制不健全、工會組織機構運行不順、農(nóng)民工自身內部條件方面和外部環(huán)境影響方面等等導致農(nóng)民工權益缺失。最后,提出工會維護農(nóng)民工權益問題相關建議和對策。包括完善工會參與農(nóng)民工權益保障制度的建設、改革工會的組織結構和隊伍建設、創(chuàng)新農(nóng)民工維權體系、完善農(nóng)民工教育文化培訓等。
[Abstract]:With the development of modern productive forces, migrant workers, as a special labor force in the process of urbanization in China, are an important part of industrial workers and the mainstay of economic construction. The legitimate rights and interests of migrant workers have not been effectively realized. Trade union organizations shoulder the important duty of protecting rights and interests of migrant workers. At present, trade unions still exist various problems in protecting the rights and interests of migrant workers, thus affecting the effectiveness of trade union rights. Wenzhou, as a non-public-owned and dominant city, has gathered a large number of migrant workers and is a high-incidence area for infringement of its rights and interests. Affected by the downward economic environment in recent years, Wenzhou is facing the double pressure of steady growth and structural adjustment. The development of enterprises has encountered a bottleneck period, and the phenomenon of the boss running the road and the closing down of enterprises has emerged one after another, bringing frequent labor disputes. The rights and interests of migrant workers are becoming more and more serious. This study is based on the above background, from the perspective of Wenzhou trade union system to the protection of migrant workers' rights and interests, empirical analysis, using literature review method, questionnaire survey and so on. On the basis of comparing the situation of labor flow between urban and rural areas in foreign countries and the labor unions' safeguarding workers' rights and interests, combining the current situation of the lack of the rights and interests of migrant workers in Wenzhou and the main measures of trade union system to protect the rights and interests of migrant This paper mainly analyzes the problems encountered by the labor union system of Wenzhou in safeguarding the labor rights, social security rights, political rights and interests of cultural life and education of migrant workers. At the same time, on the basis of the analysis of the problems, the paper summarizes the relevant reasons, including the imperfect laws and regulations and the mechanism for safeguarding the rights, and the operation of the trade union organizations. Migrant workers own internal conditions and external environmental impact and so on leading to the lack of rights and interests of migrant workers. Finally, the paper puts forward some suggestions and countermeasures to protect the rights and interests of migrant workers. It includes perfecting the trade unions' participation in the construction of the protection system for the rights and interests of migrant workers, reforming the organization structure and team construction of the trade unions, innovating the system of protecting the rights of migrant workers, and perfecting the education and cultural training of migrant workers
