【摘要】:維護(hù)社會(huì)治安是國(guó)家的基本職能,是人民對(duì)自己生存環(huán)境的基本期盼,是衡量政府治理能力的基本尺度,是推進(jìn)改革發(fā)展的基本前提。當(dāng)前,由于在轉(zhuǎn)型期經(jīng)濟(jì)、政治、文化、社會(huì)多重因素的發(fā)展變化,由此帶來(lái)的關(guān)系調(diào)整和利益矛盾,時(shí)常以影響社會(huì)治安穩(wěn)定的形式表現(xiàn)出來(lái)。本文以整體性治理理論為分析工具,主要運(yùn)用系統(tǒng)研究法、文獻(xiàn)分析法、比較研究法、問(wèn)卷調(diào)查法,對(duì)我國(guó)社會(huì)治安治理體制的歷史演進(jìn)、困境表征、“碎片化”生成機(jī)理及整體性創(chuàng)新策略等問(wèn)題進(jìn)行了分析探究,提出了具有一定創(chuàng)新的思路、見解和觀點(diǎn)。全文共分六章。第一章緒論,闡述了論文的選題背景、研究意義、關(guān)于社會(huì)治安治理的國(guó)內(nèi)外研究現(xiàn)狀、重要概念的界定、理論工具與研究方法、論文框架、創(chuàng)新之處等問(wèn)題。第二章轉(zhuǎn)型期中國(guó)社會(huì)治安治理歷程與發(fā)展特點(diǎn)。分析了社會(huì)轉(zhuǎn)型中的結(jié)構(gòu)轉(zhuǎn)換、機(jī)制轉(zhuǎn)軌、利益調(diào)整、觀念轉(zhuǎn)變對(duì)社會(huì)治安治理所帶來(lái)的挑戰(zhàn),論述了轉(zhuǎn)型期背景與社會(huì)治安治理的相關(guān)性。按照我國(guó)社會(huì)轉(zhuǎn)型的標(biāo)志性事件,將社會(huì)治安治理實(shí)踐歷程劃分為傳統(tǒng)治理模式瓦解破碎時(shí)期、混合治理模式探索運(yùn)行時(shí)期、現(xiàn)代化治理模式初步建立時(shí)期等三個(gè)階段,系統(tǒng)回顧了改革開放以來(lái)我國(guó)社會(huì)治安治理實(shí)踐的歷史脈絡(luò),從政治、經(jīng)濟(jì)、文化、社會(huì)共四個(gè)角度對(duì)其歷史演變的基本特點(diǎn)進(jìn)行了分析,提出為適應(yīng)轉(zhuǎn)型期我國(guó)政治體制由人治向法治,經(jīng)濟(jì)結(jié)構(gòu)由封閉向開放,思想意識(shí)由一元向多元,社會(huì)形態(tài)從靜態(tài)向動(dòng)態(tài)的變化,社會(huì)治安治理模式也呈現(xiàn)出治理方式法治化、治理理念服務(wù)化、執(zhí)法手段謙抑化、防控格局立體化等特點(diǎn)。第三章轉(zhuǎn)型期中國(guó)社會(huì)治安的基本狀況。該部分對(duì)改革開放以來(lái)我國(guó)每年刑事案件、治安案件、群體性事件的發(fā)案趨勢(shì)、特點(diǎn)進(jìn)行了深入分析。從傳統(tǒng)治安問(wèn)題、新型治安問(wèn)題及社會(huì)公眾的認(rèn)同程度等三個(gè)方面深入分析了當(dāng)前我國(guó)社會(huì)治安嚴(yán)峻形勢(shì)的外在表現(xiàn)及社會(huì)治安治理面臨的困境。采取調(diào)查問(wèn)卷的辦法,對(duì)一定數(shù)量的社會(huì)公眾和公安民警進(jìn)行問(wèn)卷調(diào)查分析,從問(wèn)卷參與者的主觀感受印證了治理困境的客觀存在,對(duì)其構(gòu)成因素的重要程度進(jìn)行了初步分析。第四章轉(zhuǎn)型期中國(guó)社會(huì)治安的治理困境。該部分運(yùn)用整體性治理理論工具,從主體、認(rèn)知、體制等三個(gè)方面分析了社會(huì)治安治理困境的產(chǎn)生機(jī)理,提出造成社會(huì)治安治理困境的主要因素有三個(gè)方面:一是主體因素,如公安機(jī)關(guān)不堪重負(fù)、部門治理缺乏合作、多元治理結(jié)構(gòu)尚未形成;二是認(rèn)知因素,如缺乏整體思考、缺乏公平公正精神、缺乏不斷創(chuàng)新意識(shí);三是體制因素,如職能、政策、資源、利益關(guān)系等方面的碎片化等等。通過(guò)以上分析為后續(xù)的路徑選擇提供了基礎(chǔ)。第五章國(guó)外社會(huì)治安治理的成功范例。該部分對(duì)英國(guó)、法國(guó)、瑞典、美國(guó)、加拿大、日本、新加坡等七個(gè)國(guó)家的相關(guān)經(jīng)驗(yàn)進(jìn)行介紹分析,介紹了英國(guó)不斷推進(jìn)警務(wù)體制改革、實(shí)現(xiàn)警力無(wú)增長(zhǎng)前提下實(shí)戰(zhàn)力提升的經(jīng)驗(yàn),法國(guó)探索公眾參與新形式、提升重大決策科學(xué)性的經(jīng)驗(yàn),瑞典完善社會(huì)保障體系、積極消除貧富差距的經(jīng)驗(yàn);美國(guó)加強(qiáng)經(jīng)費(fèi)投入、增強(qiáng)街面巡邏密度和實(shí)施零容忍政策的經(jīng)驗(yàn)、加拿大加強(qiáng)社會(huì)福利建設(shè)、增強(qiáng)警察執(zhí)法權(quán)威性的經(jīng)驗(yàn)、日本“交番相談員制度”推動(dòng)警民關(guān)系優(yōu)化、增多社會(huì)治安治理積極因素的經(jīng)驗(yàn)以及新加坡推進(jìn)議員聯(lián)系選民制度、及時(shí)化解社會(huì)矛盾糾紛的經(jīng)驗(yàn)。分析了國(guó)外經(jīng)驗(yàn)對(duì)提升中國(guó)社會(huì)治安治理水平的啟示意義。第六章我國(guó)社會(huì)治安治理創(chuàng)新的路徑選擇。從治理理念、組織體系、生態(tài)環(huán)境、關(guān)鍵環(huán)節(jié)、支撐體系等五個(gè)方面對(duì)中國(guó)社會(huì)治安治理的整體創(chuàng)新提出了決策建議。最后為結(jié)論與展望,本章總結(jié)了論文研究情況,對(duì)未來(lái)研究方向作了展望。與同類研究相比,本文的創(chuàng)新主要體現(xiàn)在四個(gè)方面:1、研究選題。作者搜索目前國(guó)內(nèi)文獻(xiàn)發(fā)現(xiàn),以“社會(huì)治安治理”為題的研究尚不多見。原有的相關(guān)研究多從“社會(huì)治安綜合治理”或“社會(huì)治安管理”的角度展開。當(dāng)前,我國(guó)政府提出要全面推進(jìn)國(guó)家治理體系和治理能力現(xiàn)代化。在這一背景下,運(yùn)用當(dāng)代“治理理論”的思維方法,系統(tǒng)研究“社會(huì)治安治理”問(wèn)題,具有重要的現(xiàn)實(shí)意義與理論意義。2、理論工具。整體性治理理論的產(chǎn)生環(huán)境與我國(guó)社會(huì)背景比較相近。運(yùn)用整體性治理理論研究社會(huì)治安治理具有高度契合性。為此,本文以其為理論工具,審視和分析我國(guó)社會(huì)治安治理在主體、職能、政策、資源等方面的“碎片化”問(wèn)題;還運(yùn)用社會(huì)控制理論、社會(huì)失范理論剖析了轉(zhuǎn)型期對(duì)社會(huì)治安治理的影響。均具有一定拓新價(jià)值。3、學(xué)術(shù)觀點(diǎn)。本文在綜合公共管理學(xué)、法學(xué)等基礎(chǔ)理論的基礎(chǔ)上,運(yùn)用理論分析與實(shí)證調(diào)研方法,分析了社會(huì)轉(zhuǎn)型期治安治理面臨的全新挑戰(zhàn),探討了社會(huì)建設(shè)與社會(huì)治安治理的內(nèi)在聯(lián)系,揭示了社會(huì)治安治理困境的深刻社會(huì)根源,進(jìn)而提出其治理之道必須從宏觀視野入手,努力消除產(chǎn)生社會(huì)治安治理困境的外在根源,維護(hù)良好的社會(huì)治安治理生態(tài)環(huán)境。這些學(xué)術(shù)觀點(diǎn)具有創(chuàng)新性。4、對(duì)策建議。在借鑒國(guó)外經(jīng)驗(yàn)基礎(chǔ)上,本文緊扣中國(guó)國(guó)情,提出“優(yōu)化治理理念”、“理順組織體系”、“改善生態(tài)環(huán)境”、“突出關(guān)鍵環(huán)節(jié)”、“完善支撐體系”等“五位一體”的策略,以破解我國(guó)社會(huì)治安治理困境,實(shí)現(xiàn)社會(huì)治安治理整體性創(chuàng)新。這些對(duì)策建議有一定的政策參考價(jià)值。
