【摘要】：邪教組織犯罪是利用邪教組織觸犯刑事法律,侵犯刑法所保護的各項法益進而應受刑事處罰的各種行為。邪教犯罪的本質(zhì)是反社會的,蠱惑煽動成員仇視社會,發(fā)泄對現(xiàn)實的不滿,反對政府,危害社會,甚至帶有政治野心,鼓吹、煽動推翻中國共產(chǎn)黨的領導和社會主義制度；邪教進行違法犯罪活動,危害社會,破壞正常的生產(chǎn)生活秩序,危害群眾身心健康和生命財產(chǎn)安全,延邊地區(qū)也是深受危害的邪教組織犯罪重災區(qū)。此類犯罪也對延邊地區(qū)的社會生活秩序和生活安全已經(jīng)帶來了危害安全,邪教犯罪而且近幾年呈現(xiàn)出上升趨勢。針對上述情況,本文首先對我國有關邪教犯罪的定義、特征、危害,進行闡述的基礎上,對延邊地區(qū)所呈現(xiàn)出的有關邪教組織犯罪的現(xiàn)狀進行分析并找出其特征以及所產(chǎn)生的成因,之后提出預防和打擊此類犯罪的對策。從而對延邊地區(qū)有關打擊邪教犯罪的相關部們提供法律和政策上的保障措施。本文主要分為五個部分,第一部分為緒論,主要對本文的研究目的及意義、研究方法、研究思路和研究意義進行敘述。第二部分是對我國邪教組織犯罪問題做概括性的論述,其中對邪教組織犯罪的定義、邪教組織犯罪特征及危害性,以及邪教的發(fā)展新趨勢予以闡述,旨在于明確有關邪教組織犯罪的相關概念和名詞適用,并在此基礎上對我國關于邪教組織犯罪的立法現(xiàn)狀進行梳理。第三部分是本論文的重點。通過對延邊地區(qū)邪教組織犯罪的現(xiàn)狀分析和相關特征以及成因的分析為本地區(qū)預防和打擊此類犯罪打下實證基礎。第四部分在通過上述對延邊地區(qū)邪教組織犯罪分析現(xiàn)狀的基礎上,針對性地提出實務性對策：其一,充分調(diào)動民間反邪教力量；其二,加強對弱勢群體的引導教育及宣傳；其三,重視地區(qū)經(jīng)濟結(jié)構(gòu),完善社會保障體系;其四,構(gòu)建專門的邪教組織犯罪治理機構(gòu)。
[Abstract]:The crime of cult organization is a kind of behavior that makes use of cult organization to violate criminal law and violate all kinds of legal interests protected by criminal law and should be punished by criminal law. The nature of the crime of cult is antisocial, and demagogues incite members to hate the society, vent their dissatisfaction with reality, oppose the government, harm society, even have political ambition, preach and incite to overthrow the leadership and socialist system of the Communist Party of China; Evil cults engage in illegal and criminal activities, endanger society, undermine normal order of production and life, endanger the physical and mental health of the masses, and the safety of life and property, and Yanbian region is also a severely damaged disaster area for the crimes committed by cult organizations. This kind of crime has also brought harm to the order of social life and the safety of life in Yanbian area, and the crime of cult has been on the rise in recent years. In view of the above situation, this paper first expounds the definition, characteristics, harm, and development of the crime of cults in our country. This paper analyzes the present situation of the crime of cult organization in Yanbian area, finds out its characteristics and causes of formation, and then puts forward the countermeasures to prevent and crack down on this kind of crime. Thus, it provides legal and policy safeguards for the relevant departments of cracking down on cult crimes in Yanbian area. This paper is divided into five parts, the first part is the introduction, the main purpose and significance of this study, research methods, research ideas and research significance. The second part is a general discussion on the crime of cult organization in China, in which the definition of the crime of cult organization, the characteristics and harmfulness of the crime of cult organization, and the new trend of the development of cult are expounded. The purpose of this paper is to clarify the relevant concepts and nouns related to the crime of cult organization, and on this basis, to sort out the current situation of legislation on the crime of cult organization in our country. The third part is the focus of this paper. Through the analysis of the present situation, the related characteristics and the causes of the crime of cult organization in Yanbian area, the empirical foundation is laid for the prevention and suppression of this kind of crime in this area. The fourth part, on the basis of analyzing the crime of cult organization in Yanbian area, puts forward some practical countermeasures: first, to fully mobilize the folk anti-cult forces; second, to strengthen the guidance education and propaganda to the vulnerable group; Third, attach importance to the regional economic structure and perfect the social security system.
