【摘要】：社會(huì)權(quán)是為了解決資本主義高度發(fā)達(dá)下勞資對(duì)立與貧富懸殊等各種社會(huì)矛盾與弊害,防止傳統(tǒng)的自由權(quán)保障流于空洞化,謀求全體國民特別是社會(huì)經(jīng)濟(jì)弱者的實(shí)質(zhì)自由平等,而形成的新型人權(quán)。本文分析了國家在社會(huì)權(quán)保障方面的局限性和非政府組織在社會(huì)權(quán)保障方面的積極作用以及不同階段的社會(huì)權(quán)保護(hù)模式后,提出了我國社會(huì)權(quán)保障措施:一方面,需要強(qiáng)化國家的責(zé)任,通過國家一系列積極行為為該目標(biāo)的實(shí)現(xiàn)提供一個(gè)高效、便捷、安全的法制環(huán)境,建立起完善的社會(huì)權(quán)保障法律體系;另一方面,重視非政府組織在社會(huì)權(quán)保護(hù)方面所起到的積極作用,給予其必要的法律上的支持與幫助、政策上的鼓勵(lì)與激勵(lì),同時(shí)加強(qiáng)其自身的優(yōu)勢(shì),為更好的參與社會(huì)權(quán)保障創(chuàng)造條件。
[Abstract]:The purpose of social right is to solve all kinds of social contradictions and disadvantages, such as the contradiction between labor and capital and the disparity between the rich and the poor under the highly developed capitalism, to prevent the traditional right of freedom from flowing into the void, and to seek the substantive freedom and equality of all the people, especially the weak people of society and economy. And form a new type of human rights. After analyzing the limitations of the state in the social rights protection, the active role of the non-governmental organizations in the social rights protection and the different social rights protection models in different stages, this paper puts forward the social rights protection measures in China: on the one hand, It is necessary to strengthen the responsibility of the state, to provide an efficient, convenient and safe legal environment for the realization of this goal through a series of positive acts of the state, and to establish a sound legal system for the protection of social rights; on the other hand, We should pay attention to the positive role of non-governmental organizations in the protection of social rights, give them necessary legal support and help, encourage and encourage them in policy, and strengthen their own advantages to create conditions for better participation in the protection of social rights.
