【摘要】：當(dāng)前,我國(guó)經(jīng)濟(jì)發(fā)展進(jìn)入新常態(tài),新型城鎮(zhèn)化、工業(yè)化深入推進(jìn),城鎮(zhèn)化率由改革開放初期1978年的17.9%增長(zhǎng)為2015年的56.1%,城鎮(zhèn)建設(shè)用地的不斷擴(kuò)張使得耕地?cái)?shù)量急劇減少,人地矛盾日益尖銳突出。一方面,面對(duì)十八億畝耕地紅線的壓力,城鎮(zhèn)建設(shè)用地日益緊缺;另一方面,農(nóng)村土地利用率低下,宅基地閑置浪費(fèi)嚴(yán)重。因此,有必要對(duì)宅基地加強(qiáng)管理,著重研究宅基地退出問題,盤活利用空閑農(nóng)房和宅基地,增加農(nóng)民財(cái)產(chǎn)性收入,破解城鄉(xiāng)建設(shè)用地供需矛盾,促進(jìn)城鄉(xiāng)一體化發(fā)展。本文以寧波市為例,結(jié)合《寧波市農(nóng)村宅基地管理辦法》(修訂)立法前評(píng)估調(diào)研工作,通過文獻(xiàn)研究、座談走訪、實(shí)地考察等研究方法,對(duì)寧波市宅基地退出現(xiàn)狀及存在問題進(jìn)行調(diào)研分析,并在此基礎(chǔ)上提出完善寧波市宅基地退出的對(duì)策及保障措施建議。本文的主要研究及結(jié)論如下:1.通過對(duì)寧波市宅基地退出現(xiàn)狀進(jìn)行分析,歸納出寧波市宅基地退出的四種具體操作模式,發(fā)現(xiàn)總結(jié)其中存在的主要問題,認(rèn)為寧波市宅基地退出存在著農(nóng)民參與程度偏低、輕視宅基地零散退出、隨意更改宅基地退出審批流程、社會(huì)保障落實(shí)程度偏低以及宅基地退出補(bǔ)償資金單一緊缺等問題,認(rèn)真分析產(chǎn)生上述問題的制度缺陷和主觀原因。2.宅基地退出要結(jié)合寧波市各地實(shí)際情況,著重推行村級(jí)土地民主管理,提升農(nóng)民參與宅基地退出的積極性和主動(dòng)性,因地制宜地完善宅基地退出模式:規(guī)范整村退出模式和創(chuàng)新零散退出模式。同時(shí)結(jié)合本地實(shí)際,設(shè)計(jì)了一整套宅基地退出具體操作流程,規(guī)范宅基地退出行為。為了確保退出農(nóng)戶利益不受損,結(jié)合當(dāng)前的拆遷補(bǔ)償政策,應(yīng)當(dāng)實(shí)施多樣化的補(bǔ)償方式,逐步提高補(bǔ)償標(biāo)準(zhǔn)。此外,進(jìn)一步研究宅基地退出的配套管理措施,如建立宅基地退出專項(xiàng)基金、加強(qiáng)退出后宅基地的盤活利用等。3.為了更好地促進(jìn)、保障宅基地退出的順利實(shí)施,提出了完善宅基地審批監(jiān)管制度、重建宅基地有償使用制度、推廣宅基地流轉(zhuǎn)制度、推進(jìn)農(nóng)村不動(dòng)產(chǎn)統(tǒng)一登記制度以及建立農(nóng)村住房保障體系等保障措施建議。
[Abstract]:At present, the economic development of our country has entered the new normal, the new type of urbanization and industrialization have been advanced deeply, the urbanization rate has increased from 17.9% in 1978 to 56.1% in 2015 in the early stage of reform and opening up. The continuous expansion of urban construction land has resulted in a sharp decrease in the amount of cultivated land. The contradiction between man and land is becoming more and more acute. On the one hand, facing the pressure of 1.8 billion mu of cultivated land red line, urban construction land is increasingly scarce; on the other hand, the utilization ratio of rural land is low, and the idle waste of residential land is serious. Therefore, it is necessary to strengthen the management of homestead, focus on the issue of homestead withdrawal, activate the use of free agricultural houses and homestead, increase the property income of farmers, solve the contradiction between supply and demand of urban and rural construction land, and promote the integration of urban and rural development. This article takes Ningbo as an example, combining with "Ningbo Rural Housing Land Management method" (revised) pre-legislative evaluation and investigation, through literature research, discussion visits, field visits and other research methods, On the basis of investigation and analysis of the present situation and existing problems of Ningbo's homestead withdrawal, the author puts forward the countermeasures and suggestions to perfect Ningbo's homestead withdrawal. The main research and conclusions of this paper are as follows: 1. Based on the analysis of the current situation of Ningbo homestead withdrawal, four specific operation modes of Ningbo Homestead withdrawal are summarized, and the main problems are found out, and the farmers' participation in Ningbo Homestead withdrawal is considered to be on the low side. This paper despises the scattered withdrawal of the homestead, changes the examination and approval process of the Homestead at will, the low degree of social security implementation and the single shortage of the compensation fund for the Homestead withdrawal, and seriously analyzes the institutional defects and subjective causes of the above problems. The withdrawal of homestead should combine with the actual situation in various parts of Ningbo, emphasize the democratic management of village-level land, and promote the enthusiasm and initiative of farmers to participate in the homestead withdrawal. Perfect homestead exit mode according to local conditions: standardize the whole village exit mode and innovate scattered exit mode. At the same time, combined with the local reality, designed a set of homestead exit specific operation process, standardized homestead withdrawal behavior. In order to ensure that the interests of withdrawing farmers will not be damaged, and combining with the current policy of compensation for demolition, we should implement a variety of compensation methods and gradually improve the standard of compensation. In addition, further research on the supporting management measures of homestead withdrawal, such as the establishment of homestead withdrawal fund, to strengthen the reactivation of homestead after withdrawal. 3. In order to better promote and guarantee the smooth implementation of homestead withdrawal, this paper puts forward to improve the supervision system of homestead examination and approval, to rebuild the system of homestead paid use, and to promote the homestead circulation system. To promote the unified registration system of rural real estate and the establishment of rural housing security system and other security measures.
