【摘要】：社會保障權(quán)是被國際法所承認的公民應(yīng)該享有的一項基本權(quán)利。我國憲法明確規(guī)定公民享有社會保障權(quán)。農(nóng)民是我國公民的主體部分,理所當然享有憲法所賦予的這項權(quán)利。由于我國歷史因素所形成的二元制社會經(jīng)濟結(jié)構(gòu),造成城鄉(xiāng)居民社會保障存在差異,農(nóng)民的社會保障權(quán)至今不能得到有效保障,許多保障項目農(nóng)民被排除在社會保障制度之外,造成農(nóng)民社會保障權(quán)的缺失。 隨著改革向深度和廣度的發(fā)展,我國農(nóng)村、農(nóng)業(yè)和農(nóng)民問題在競爭激烈的市場經(jīng)濟中更加突出,而建立和完善我國農(nóng)民社會保障制度和體系,保障農(nóng)民的社會保障權(quán)是解決這些問題的重要手段和途徑。從我國目前農(nóng)民的社會保障現(xiàn)狀來看主要存在保障體系不完善,保障水平低,項目覆蓋面窄,思想認識不夠等問題。 造成這樣的問題不僅有現(xiàn)實的原因還有觀念的障礙,不僅有經(jīng)濟基礎(chǔ)的限制還有法律和政治的制約,為此本文強調(diào)構(gòu)建完善的農(nóng)民社會保障制度,不僅需要制定專門法,還需要其他法律部門及相關(guān)配套措施的協(xié)調(diào)。要加強農(nóng)民社會保障權(quán)實現(xiàn)的立法保障、完善農(nóng)民社會保障權(quán)實現(xiàn)的救濟體系、健全農(nóng)民社會保障權(quán)實現(xiàn)的組織體系。要完善以憲法為主的其它相關(guān)法律的配套改革,增強農(nóng)民的社會保障法律意識,通過加強農(nóng)村的法制建設(shè)與法制宣傳教育,強化農(nóng)民的自我保障意識。要以科學的立法觀為指導,積極探討能夠指導立法與司法實踐的社會保障法律制度理論,充分吸收域外農(nóng)村社會保障立法的先進研究成果,結(jié)合我國的實際情況,不斷完善我國農(nóng)民社會保障制度。 從總體上說,在我國農(nóng)村,農(nóng)民的社會保障體系格局基本形成,但體系還不健全,而且在實施過程中還存在諸多問題,這使農(nóng)民的社會保障權(quán)還不能得到有效的切實保護。因此,完善的農(nóng)村社會保障體系既是解決我國“三農(nóng)”問題和我國經(jīng)濟社會持續(xù)發(fā)展的迫切需要,同時也是廣大農(nóng)村居民的迫切期待。 維護農(nóng)民社會保障權(quán)的實現(xiàn)不僅僅是完善體制、制度問題,更重要的是政治和經(jīng)濟問題。在建設(shè)社會主義和諧社會的環(huán)境下,維護農(nóng)民社會保障權(quán)是和諧社會本質(zhì)要求,表征了農(nóng)民對社會保障權(quán)的正義訴求。
[Abstract]:The right to social security is a basic right recognized by international law.Our Constitution clearly stipulates that citizens enjoy the right to social security.Farmers are the main part of our citizens, naturally enjoy the right given by the Constitution.Because of the dualistic social and economic structure formed by the historical factors of our country, there are differences in the social security of urban and rural residents, and the peasants' right to social security has not been effectively guaranteed, and many farmers have been excluded from the social security system.The loss of farmers' right to social security.With the development of the reform to the depth and breadth, the problems of rural areas, agriculture and farmers are more prominent in the competitive market economy, and the establishment and improvement of the social security system and system of farmers in our country.Protecting farmers' right to social security is an important means and way to solve these problems.According to the present situation of social security of farmers in China, there are some problems such as imperfect security system, low security level, narrow project coverage and insufficient ideological understanding.There are not only practical reasons but also obstacles to ideas, not only the restriction of economic base, but also the restriction of law and politics. Therefore, this paper emphasizes the construction of a perfect social security system for farmers, and not only needs to formulate special laws,Also need the coordination of other legal departments and related supporting measures.It is necessary to strengthen the legislative protection of the realization of peasants' right to social security, perfect the relief system for the realization of peasants' right to social security, and perfect the organizational system for the realization of peasants' right to social security.It is necessary to perfect the supporting reform of other related laws, strengthen the farmers' legal consciousness of social security, and strengthen the farmers' consciousness of self-security by strengthening the construction of the rural legal system and the propaganda and education of the legal system.Guided by a scientific view of legislation, we should actively explore the theory of social security legal system that can guide legislation and judicial practice, fully absorb the advanced research results of rural social security legislation abroad, and combine with the actual situation in our country.We will continue to improve our farmers' social security system.Generally speaking, in the countryside of our country, the pattern of social security system of farmers is basically formed, but the system is not perfect, and there are still many problems in the process of implementation, which makes the farmers' right to social security can not be effectively and practically protected.Therefore, the perfect rural social security system is not only the urgent need to solve the problems of "agriculture, countryside and farmers" and the sustainable development of our country's economy and society, but also the urgent expectation of the vast number of rural residents.The realization of protecting peasants' right to social security is not only a matter of perfecting system and system, but also of politics and economy.In the context of building a harmonious socialist society, maintaining the farmers' right to social security is the essential requirement of a harmonious society, which represents the just demand of the peasants for the right to social security.
