【摘要】：伴隨著人口老齡化成為當(dāng)今世界一個突出的社會問題,老年人的養(yǎng)老問題也日益沖擊著各國的經(jīng)濟(jì)、社會、文化、家庭和個人,養(yǎng)老成為老年人及整個社會必須面對的話題。作為應(yīng)對人口老齡化養(yǎng)老問題的基本制度的社會保障法律制度,得到了不論是發(fā)達(dá)國家還是發(fā)展中國家的普遍重視。雖然我國也形成了以老年人權(quán)益保障法為核心的養(yǎng)老法律制度,但仍存在相關(guān)養(yǎng)老法律制度原則性較強(qiáng)、難以操作等問題。老年人養(yǎng)老權(quán)利的法治保障首先在于優(yōu)化立法,在于用立法保障養(yǎng)老權(quán)。在養(yǎng)老立法理念方面,應(yīng)突出立法的動態(tài)性、預(yù)見性和全面性;在立法內(nèi)容方面,應(yīng)突出政府在養(yǎng)老中的責(zé)任,明確養(yǎng)老的對象及養(yǎng)老的方式;在立法體系方面,應(yīng)構(gòu)建中央立法、行政法規(guī)、地方法規(guī)和規(guī)章三位一體的養(yǎng)老權(quán)益保護(hù)法律體系。
[Abstract]:With the aging of the population has become a prominent social problem in the world, the aging of the elderly is increasingly impacting the economy, society, culture, family and individuals of all countries. The elderly and the whole society must face the topic of old-age support.The legal system of social security, which is the basic system to deal with the aging of the population, has been paid much attention by both developed and developing countries.Although China has also formed the old-age legal system with the law of the protection of the rights and interests of the elderly as the core, there are still some problems such as strong principle and difficulty in operation of the related legal system for the aged.The legal protection of the aged pension rights lies in the optimization of legislation and the protection of the right to the aged by legislation.In terms of the concept of legislation for the aged, we should highlight the dynamic, predictable and comprehensive nature of the legislation; in the content of the legislation, we should stress the responsibility of the government in providing for the aged, make clear the object and the way of providing for the aged, and in the aspect of the legislative system,The central legislation, administrative regulations, local laws and regulations should be set up to protect the rights and interests of the aged.
