【摘要】：生育保障作為社會(huì)保障的一部分,是憲法規(guī)定的公民基本權(quán)利。國(guó)家通過(guò)財(cái)稅手段激勵(lì)和保障生育政策的落實(shí),也面臨正當(dāng)性、公平性與合理性的考量。我國(guó)全面放開二孩之后,如何利用好本土資源以發(fā)揮財(cái)稅法的激勵(lì)功能,在財(cái)政領(lǐng)域需要完善補(bǔ)貼程序、標(biāo)準(zhǔn)、形式和支出責(zé)任的制度供給,改變現(xiàn)行補(bǔ)貼政策中各自為政的無(wú)序狀態(tài);在稅收領(lǐng)域需要構(gòu)建以分類綜合所得稅制改革為核心的費(fèi)用扣除制度,規(guī)范和清理現(xiàn)行的減免設(shè)計(jì)。同時(shí),借鑒美國(guó)特朗普政府關(guān)于生育激勵(lì)的稅改計(jì)劃和歐美國(guó)家的家庭財(cái)稅激勵(lì)制度,以進(jìn)行更好的技術(shù)取舍和價(jià)值判斷,從單一激勵(lì)和生育激勵(lì)最終走向多元激勵(lì)和養(yǎng)育激勵(lì),實(shí)現(xiàn)財(cái)稅激勵(lì)的功能互補(bǔ)和平等保護(hù)。
[Abstract]:As a part of social security, maternity security is a basic right of citizens stipulated in the Constitution. The state also faces legitimacy in encouraging and ensuring the implementation of fertility policies through fiscal and taxation means. Consideration of fairness and reasonableness. How to make good use of local resources to give full play to the incentive function of fiscal and taxation laws after China has fully opened up the second child, we need to improve the system supply of subsidy procedures, standards, forms and expenditure responsibilities in the financial field. To change the disorderly state of the existing subsidy policy, we need to construct the expense deduction system with the reform of the taxable and comprehensive income tax system as the core in the tax field, standardize and clean up the current design of the reduction and reduction. At the same time, Referring to the tax reform plan of the US Trump administration on fertility incentive and the family finance and tax incentive system of European and American countries, in order to make better technology choice and value judgment, from single incentive and fertility incentive to pluralistic incentive and nurturing incentive. To achieve the function of fiscal incentives and equal protection.
