【摘要】：在歷時(shí)性視覺,未成年人監(jiān)護(hù)制度作為歷史范疇,呈示出從家庭主義經(jīng)由個人主義到國家主義的演進(jìn)規(guī)律。在共時(shí)性視野,未成年人監(jiān)護(hù)制度作為社會范疇,表現(xiàn)出公法化、社會化時(shí)代走向�，F(xiàn)代產(chǎn)業(yè)分工和社會保障事業(yè)、公共服務(wù)體系的發(fā)展,現(xiàn)代人的需要結(jié)構(gòu)中精神需要的增強(qiáng),文化結(jié)構(gòu)中個人獨(dú)立性意識提高,家庭結(jié)構(gòu)中核心家庭的上升與主導(dǎo)作用,是影響未成年人監(jiān)護(hù)法現(xiàn)代變革的重要因素。我國現(xiàn)行未成年人監(jiān)護(hù)的制度理念中,表現(xiàn)出明顯的重家庭責(zé)任、輕國家責(zé)任,重親屬監(jiān)護(hù)、輕社會監(jiān)護(hù),重私力自治、輕公力干預(yù),重固有傳統(tǒng)、輕繼受文明,重扶養(yǎng)關(guān)系、輕監(jiān)護(hù)體系,重身份倫理道德、輕法律規(guī)制調(diào)整,重單位基層義務(wù)、輕政府公益保障,重人身監(jiān)護(hù)、輕財(cái)產(chǎn)監(jiān)護(hù)的特點(diǎn)。中國民法典重構(gòu)未成年人監(jiān)護(hù)制度,必須充分考量近40年的改革成果和全面建設(shè)小康社會的時(shí)代驅(qū)動,遵循六個規(guī)律、五項(xiàng)原則,把握五大關(guān)系。
[Abstract]:In the diachronic, the guardianship system for minors as a historical category, shows the evolution law from familist through individualism to nationalism. In a synchronic perspective, the guardianship system for minors as a social category, showing the law, social trend. Modern industrial division of labor and social security, the development of public service system, enhancing the spiritual needs of modern people in the structure, improve the personal independence consciousness in the cultural structure, the rise and the leading role of core family structure, is an important factor affecting the guardianship of Minors Act of modern change. Our current guardianship system concept, showed the family light weight responsibility, national responsibility, family guardianship, light social care, heavy private autonomy, public power intervention light, heavy traditional light after the civilization, heavy dependency, light monitoring system, identity. Ethical, legal regulation to adjust light, heavy duty unit grass-roots government public security, light weight, personal care, light property guardianship. Reconstruction of the civil code Chinese minors guardianship system, must fully consider the nearly 40 years of achievements in reform and building a well-off society in the era of the drive, follow the six rules, five the principle, grasp the relationship between the five.
