【摘要】：殘疾老年人群體的弱勢(shì)特征非常明顯,經(jīng)濟(jì)困難并且對(duì)家庭依賴程度高,護(hù)理需求巨大,且生活質(zhì)量較低,通常情況下自我維權(quán)意識(shí)差。湖南省殘疾老年人群體的現(xiàn)狀是國(guó)內(nèi)此群體的縮影,經(jīng)對(duì)殘疾老年人群體所面臨的問題進(jìn)行法律分析,發(fā)現(xiàn)現(xiàn)行殘疾老年人的相關(guān)法律法規(guī)過于籠統(tǒng),缺乏可操作性,并且司法維權(quán)缺少具體程序。法律保障信息不透明,相關(guān)監(jiān)督制度存在缺陷等等�；趯で蠼鉀Q殘疾老年人群相關(guān)問題的對(duì)策,本文主要采用數(shù)據(jù)分析及理論分析的方法,從四個(gè)部分進(jìn)行論述:第一部分分析我國(guó)殘疾老年人權(quán)益保障所面臨的問題,論述現(xiàn)階段殘疾老年人法律權(quán)益保障制度的現(xiàn)狀。第二部分主要用相關(guān)數(shù)據(jù)表格闡述湖南殘疾老年人法制權(quán)益保障所面臨現(xiàn)狀,剖析在湖南發(fā)生的典型案例,并分析現(xiàn)狀的成因。第三部分主要研究德國(guó)、美國(guó)、日本殘疾老年人的權(quán)益保障法及權(quán)益保障制度,探尋這些國(guó)家的社會(huì)養(yǎng)殘養(yǎng)老服務(wù)、康復(fù)服務(wù)、出行及交通服務(wù)、福利津貼等方面、完善的權(quán)益保障制度以及適合本國(guó)國(guó)情發(fā)展的政策及法律的方法、特點(diǎn),并思考對(duì)我國(guó)相關(guān)立法及制度政策、制度構(gòu)建的借鑒。第四部分創(chuàng)新性的為完善我國(guó)殘疾老年人權(quán)益保障的制度建言獻(xiàn)策,我國(guó)需要建立完善的殘疾老年人權(quán)益保障制度。首先應(yīng)建立完善的法律援助制度,降低法律援助門檻,將法律援助范圍擴(kuò)大,加強(qiáng)相關(guān)管理工作,促使司法援助制度得到不斷完善。其次是建立全面可行的權(quán)益保障制度,健全養(yǎng)殘制度,社會(huì)保險(xiǎn)及社會(huì)救濟(jì)、救助制度�，F(xiàn)階段必須完善殘疾老年人相關(guān)法律文件,完善相關(guān)監(jiān)管部門的工作,使得他們能夠在其位辦其事,真正做到全方位為殘疾老年人服務(wù),從各方面維護(hù)他們的權(quán)益。
[Abstract]:The vulnerable characteristics of the group of older persons with disabilities are very clear, they are economically difficult and highly dependent on their families, the need for care is enormous and the quality of life is low, The current situation of the disabled elderly group in Hunan Province is the epitome of this group in China. Found that the current laws and regulations of the elderly with disabilities are too general, lack of maneuverability, lack of specific procedures for judicial protection, and lack of transparency in legal protection information, Based on the countermeasures to solve the problems related to the elderly population with disabilities, this paper mainly adopts the methods of data analysis and theoretical analysis. It is discussed from four parts: the first part analyzes the problems faced by the protection of the rights and interests of the disabled elderly in our country. The second part mainly uses the related data table to expound the current situation of the legal rights and interests protection of the disabled elderly people in Hunan Province, and analyzes the typical cases in Hunan Province, and discusses the current situation of the legal rights and interests protection system of the disabled elderly people at the present stage. The third part mainly studies the rights and interests of the elderly with disabilities in Germany, the United States and Japan, and explores the social care and retirement services, rehabilitation services, travel and transportation services in these countries. Welfare allowance and so on, the perfect rights and interests protection system, the policy and the law method, the characteristic which suits the national condition development, and the consideration to our country related legislation and the system policy, 4th part of innovative advice to improve the protection of the rights and interests of the elderly with disabilities, China needs to establish a perfect system of protection of the rights and interests of the elderly with disabilities. First, we should establish a perfect legal aid system. Lowering the threshold of legal aid, expanding the scope of legal aid, strengthening the relevant management work, and promoting the continuous improvement of the judicial aid system. Secondly, it is necessary to establish a comprehensive and feasible system of protection of rights and interests, perfect the system of maintenance of the disabled, social insurance and social relief. At this stage, we must perfect the relevant legal documents of the disabled elderly, perfect the work of the relevant supervision department, so that they can do their work in their own right, so that they can truly serve the disabled elderly in all aspects and safeguard their rights and interests from all aspects.
