【摘要】：隨著社會(huì)的不斷發(fā)展,建立以社會(huì)救助為基礎(chǔ)、社會(huì)保險(xiǎn)為主體、社會(huì)福利為補(bǔ)充的社會(huì)保障制度成為體現(xiàn)黨和政府以人為本,關(guān)注民生的重要舉措。社會(huì)救助是保障弱勢群體基本生活,維護(hù)社會(huì)秩序,維護(hù)社會(huì)穩(wěn)定、促進(jìn)社會(huì)和諧的重要環(huán)節(jié)。相比過去社會(huì)救濟(jì)的被動(dòng)性、慈善性和暫時(shí)性,民國時(shí)期社會(huì)救濟(jì)更加體現(xiàn)了政府在救濟(jì)過程中的主動(dòng)性、責(zé)任性、長期性。南京國民政府在1943年頒布了《社會(huì)救濟(jì)法》,雖然其最后實(shí)施的效果甚微,但是從立法技術(shù)的角度來看,該法代表著民國時(shí)期社會(huì)救濟(jì)立法最高成就,為了使救濟(jì)的執(zhí)行力度上得到保證,防止出現(xiàn)權(quán)力腐敗,民國時(shí)期又出臺(tái)了一系列配套法規(guī)和制度,通過法律規(guī)范救濟(jì)主管機(jī)關(guān)、辦賑人員的權(quán)限。尤其是賑務(wù)人員在進(jìn)行社會(huì)救濟(jì)時(shí)應(yīng)該遵守的規(guī)章制度。民國1943年的《社會(huì)救濟(jì)法》及其相關(guān)法律明確了中央、地方的救濟(jì)主體,從救濟(jì)主體的權(quán)限及其行使方式、救濟(jì)對(duì)象的范圍及識(shí)別程序、懲戒社會(huì)救濟(jì)過程中的腐敗行為、對(duì)救濟(jì)主體的嚴(yán)格行政管理措施和監(jiān)管社會(huì)救濟(jì)設(shè)施的適用等方面規(guī)制公權(quán)力機(jī)關(guān)在社會(huì)救濟(jì)活動(dòng)中的作為和不作為。民國社會(huì)救濟(jì)法體系對(duì)公權(quán)力的規(guī)制方面的經(jīng)驗(yàn)仍然有值得學(xué)習(xí)和借鑒之處。
[Abstract]:With the continuous development of society, the establishment of a social security system based on social assistance, social insurance as the main body and social welfare as a supplement has become the embodiment of the party and government people-oriented. Important measures to pay attention to people's livelihood. Social assistance is an important link in ensuring the basic life of vulnerable groups, maintaining social order, maintaining social stability, and promoting social harmony. Compared with the passive nature of social relief in the past, it is charitable and temporary. During the period of the Republic of China, social relief showed the initiative, responsibility and long-term nature of the government in the relief process. In 1943, the Nanjing National Government promulgated the Social Relief Law, although it had little effect in the final implementation. However, from the point of view of legislative technology, this law represents the highest achievement of social relief legislation in the Republic of China. In order to ensure the enforcement of relief and prevent power corruption, a series of supporting laws and regulations were issued during the Republic of China. Through the legal regulation of the competent relief authority, the authority of the relief personnel, especially the rules and regulations that the relief personnel should abide by when carrying out social relief. The Social Relief Law of 1943 of the Republic of China and its related laws clearly defined the central authorities. The local relief subject, from the power of the relief subject and the way of its exercise, the scope of the relief object and the identification procedure, the punishment of corruption in the process of social relief, Strict administrative measures for relief subjects and supervision of the application of social relief facilities etc. Regulation of acts and omissions of public power organs in social relief activities. Regulation of Public Power by the Social Relief Law system of the Republic of China. Our experience is still worth learning and learning from.
