【摘要】：隨著時(shí)代的發(fā)展,新生代農(nóng)民工逐漸取代老一代農(nóng)民工在勞動(dòng)力市場的地位,成為我國勞動(dòng)力市場的主力軍,為我國的城市建設(shè)和經(jīng)濟(jì)發(fā)展做出重大的貢獻(xiàn)。同時(shí),新生代農(nóng)民工在逐漸發(fā)展壯大的過程中也顯現(xiàn)了大量的問題,有關(guān)他們權(quán)益保障的問題也成為全國人民關(guān)注的重點(diǎn)。新生代農(nóng)民工有他們自身的特點(diǎn),比如,受教育程度較高,思維活躍,接受新事物的能力遠(yuǎn)遠(yuǎn)強(qiáng)與第一代農(nóng)民工,他們關(guān)心政治,關(guān)心自身的發(fā)展,維權(quán)意識(shí)也大大增強(qiáng)。在現(xiàn)實(shí)生活中,新生代農(nóng)民工的就業(yè)權(quán)、勞動(dòng)報(bào)酬權(quán)、休息休假權(quán)等合法權(quán)利卻沒有得到足夠的重視,很容易受到侵害,并且與城市居民所享有的福利相比有巨大的差異。究其原因,不僅有國家政策滯后的原因,更重要的是法律沒有給予他們應(yīng)有的保障,同時(shí)新生代農(nóng)民工自身法制意識(shí)薄弱也對他們自身權(quán)益的保障非常不利。因此,我們需要針對新生代農(nóng)民工群體的特點(diǎn),在現(xiàn)行法律的基礎(chǔ)上,深入討論研究,彌補(bǔ)現(xiàn)行法律的空白和缺陷,對我國新生代農(nóng)民工權(quán)益保障提出完善的建議,以便更好的維護(hù)他們的合法權(quán)益,進(jìn)而更大的推動(dòng)和諧社會(huì)的進(jìn)步和國家經(jīng)濟(jì)的發(fā)展。本文具體研究內(nèi)容主要包括五部分:第一部分,主要對新生代農(nóng)民工的概念作出界定,概括這一特殊群體的特征,從新生代農(nóng)民工的產(chǎn)生和發(fā)展出發(fā),深入了解新生代農(nóng)民工的基本狀況。第二部分,因新生代農(nóng)民工權(quán)益保障問題的法律制度主要體現(xiàn)在社會(huì)保障層面,因此對我國新生代農(nóng)民工的社會(huì)保障制度理論做出系統(tǒng)的闡述,明確我國社會(huì)保障人權(quán)理念、公平理念、法治理念在新生代農(nóng)民工社會(huì)保障中的體現(xiàn)。第三部分,對新生代農(nóng)民工權(quán)益保障的現(xiàn)狀進(jìn)行剖析,明確目前對新生代農(nóng)民工保障的問題所在。第四部分通過對新生代農(nóng)民工權(quán)益遭受侵害的原因加以分析,從根本上尋求解決問題的切入點(diǎn)。第五部分,對我國新生代農(nóng)民工權(quán)益保障完善提出建議。通過對現(xiàn)有法律法規(guī)進(jìn)一步完善和政策的改革提出相應(yīng)建議,使新生代農(nóng)民工今后能夠得到更好的保障。
[Abstract]:With the development of the times, the new generation of migrant workers gradually replace the position of the older generation of migrant workers in the labor market, and become the main force of our country's labor market. At the same time, the new generation of migrant workers in the process of gradual development and expansion has also revealed a large number of problems. The new generation of migrant workers have their own characteristics, such as higher education level, active thinking. The ability to accept new things is far stronger than the first generation of migrant workers, they care about politics, care for their own development, the awareness of rights is also greatly enhanced. In real life, the new generation of migrant workers' right to employment, labor compensation rights. The right to rest and leave and other legal rights have not been paid enough attention, it is easy to be infringed, and compared with the welfare of urban residents, there is a huge difference. What is more important is that the law does not give them due protection, and the weak legal consciousness of the new generation of migrant workers is also very disadvantageous to their own rights and interests. We need to focus on the characteristics of the new generation of migrant workers, on the basis of the existing laws, in-depth discussion and research, to make up for the gaps and shortcomings of the existing laws, and to improve the protection of the rights and interests of the new generation of migrant workers in China. In order to better protect their legitimate rights and interests, and then promote the progress of a harmonious society and the development of national economy. Mainly defines the concept of the new generation of migrant workers, summarizes the characteristics of this special group, starting from the generation and development of the new generation of migrant workers, in-depth understanding of the basic situation of the new generation of migrant workers. Part two. Because the legal system of the protection of the rights and interests of the new generation of migrant workers is mainly reflected in the level of social security, the theory of the social security system of the new generation of migrant workers in China is expounded systematically. Clear the concept of human rights of social security, fair concept, the concept of the rule of law in the new generation of migrant workers in the social security embodied. The third part, the new generation of migrant workers rights and interests of the analysis of the status quo. Clear the current generation of migrant workers security problems. Part 4th through the new generation of migrant workers rights and interests of the analysis of the cause of infringement, from the root to find a solution to the problem. 5th part. Some suggestions are put forward to improve the protection of the rights and interests of the new generation of migrant workers in China. Through the further improvement of the existing laws and regulations and the reform of the policies, the new generation of migrant workers can be better protected in the future.
