【摘要】：中國是眾所周知的世界人口大國,人口基數(shù)眾多,龐大的人口對(duì)政治、經(jīng)濟(jì)和文化帶來不可忽視的壓力,同時(shí)也對(duì)生態(tài)環(huán)境造成巨大壓力,為了順應(yīng)社會(huì)發(fā)展的需要,我國提出“計(jì)劃生育”的基本國策,是符合人口發(fā)展趨勢的,適當(dāng)控制人口增長,將一定程度上有利于社會(huì)發(fā)展。近三十年來,我國實(shí)施計(jì)劃生育政策,產(chǎn)生了一定的正面影響,顯而易見的是有效控制了人口數(shù)量,另外,也一定程度上提高了國民人口素質(zhì),除了這些積極影響,不可否認(rèn)的是,負(fù)面影響也逐漸顯現(xiàn),比如:出生人口性別比例失衡,這些都是計(jì)劃生育政策實(shí)施過程中不可忽視的問題。對(duì)此,為了順應(yīng)時(shí)代發(fā)展潮流,為了順應(yīng)外部環(huán)境的改變,我國十八屆三中全會(huì)出臺(tái)了啟動(dòng)“單獨(dú)二胎”的決定,這是對(duì)現(xiàn)有計(jì)劃生育政策做出的合理調(diào)整,這樣的改變調(diào)整最終將促進(jìn)人口社會(huì)和生態(tài)的和諧發(fā)展。我黨十八屆五中全會(huì)確認(rèn)了全面二胎政策的正式推行,終結(jié)了國內(nèi)長達(dá)三十年之久的獨(dú)生子女政策�！皢为�(dú)二胎”政策實(shí)行不過兩年,全面二胎政策就緊隨而至。此番政策的加速落地一方面來自于廣大人民群眾的熱切期盼,另外政府也對(duì)相關(guān)政策做出了科學(xué)評(píng)測。站在國內(nèi)經(jīng)濟(jì)未來發(fā)展的角度來看,全面二胎政策的落地將對(duì)彌補(bǔ)勞動(dòng)力缺口帶來重要影響。另外,生育水平的提升將直接對(duì)相關(guān)生產(chǎn)領(lǐng)域的整體運(yùn)營構(gòu)成影響,創(chuàng)造更多的投資良機(jī)。本文探究相關(guān)理念,為課題研究作好準(zhǔn)備,以我國二胎政策為研究主題,圍繞“我國二胎政策相關(guān)法律問題研究”為主線,通過界定二胎政策的概念,解讀二胎政策并分析其帶來的影響,進(jìn)而歸納出其所存在的相關(guān)法律問題,在此基礎(chǔ)上探索如何加強(qiáng)二胎政策的推行,以實(shí)現(xiàn)二胎政策中法律的優(yōu)化。首先是緒論,研究背景與意義,國內(nèi)外研究現(xiàn)狀,概述了研究思路和方法;其次第二章二胎政策的相關(guān)理論概述,論述了我國二胎政策相關(guān)界定以及實(shí)施帶來的影響,包括國家政治、社會(huì)經(jīng)濟(jì)、個(gè)人家庭這幾方面;第三章分析了我國二胎政策實(shí)施的現(xiàn)狀,首先分析了全面二胎實(shí)施的原因,之后從五方面論述存在的現(xiàn)狀問題:夫妻生育權(quán)的問題、性別區(qū)別對(duì)待問題、繼承權(quán)平等的問題、人工生殖技術(shù)的問題、社會(huì)撫養(yǎng)費(fèi)的問題;第四章針對(duì)存在的問題提出相關(guān)法律問題的對(duì)策:夫妻生育權(quán)利的保障、男女性別的方面對(duì)策、繼承權(quán)的完善策略、構(gòu)建我國人工生殖技術(shù)法制、加強(qiáng)社會(huì)撫養(yǎng)費(fèi)征收管理;最后第五章對(duì)全文作出總結(jié)。論文研究只是淺要對(duì)我國二胎政策作出分析,在今后還需要進(jìn)一步加強(qiáng)。
[Abstract]:As everyone knows Chinese is the world's most populous country, population is numerous, the political large population brings pressure on the economy and culture, but also caused great pressure on the ecological environment, in order to meet the need of social development, our country puts forward "the basic national policy of family planning", is in line with the trend of population development, appropriate to control population growth, to a certain extent, is conducive to social development. In the past thirty years, the implementation of family planning policy in China, has produced some positive effects, obviously is the effective control of the population, in addition, also improves the national quality of the population, in addition to these positive effects, it is undeniable that the negative impact is gradually emerging, such as: gender imbalance at birth, these are the problems that can not be ignored in the process of implementing the policy of family planning. In this regard, in order to adapt to the development trend of the times. To adapt to the external environment change, our country introduced in the third Plenary Session of the 18th CPC Central Committee launched the "separate second child" decision, it is reasonable to make adjustments to the existing family planning policy, this change will ultimately promote the harmonious development of population, society and ecology. The Communist Party of China in the fifth Plenary Session of the 18th CPC Central Committee confirmed the overall two-child policy formally launched, the end of the home for thirty years for the one-child policy. The second child alone policy but for two years, followed by comprehensive two-child policy will accelerate the landing. Looking forward to on the one hand from the masses of the policy, the government also made a scientific evaluation of the relevant policies. At the future development of the domestic economy point of view, a comprehensive two-child policy. The floor will bring important influence to compensate for the labor gap. In addition, the fertility level of ascension will directly to the related production area whole body The operation of impact, create more investment opportunities. This paper explores the related concepts, to prepare for the research on China's two-child policy as the research subject, research on the related legal issues in China two-child policy as the main line, through the definition of the concept two-child policy, interpretation two-child policy and analyzing its effects, and then summed up the relative legal problems exist, based on the exploration of how to strengthen the two-child policy implementation, to realize the optimization of the legal two-child policy. The first is the introduction, research background and significance, research status at home and abroad, summarizes the research ideas and methods; the theory outlined in the second chapter, two-child policy, discussed China's second child the definition and implementation of policy related effects brought about, including the national political, economic and social, personal family in these areas; the third chapter analyzes the current situation of China's two-child policy implementation, first of all Analysis of the causes of comprehensive implementation of the second, after the existing problems discussed from five aspects: the spouse birth right, sex discrimination, equal inheritance rights problem, artificial reproductive technology, social compensation fee; the fourth chapter puts forward countermeasures to solve the existing problems related to legal issues: couple reproductive rights security measures, gender, policy inheritance rights, constructing China's legal system of artificial reproductive technology, strengthen the administration of collection of social maintenance fees; finally, the fifth chapter summarizes this thesis. This thesis is a shallow analysis on China's two-child policy to further strengthen in the future.
