        實(shí)現(xiàn)社會(huì)和諧，始終是人類(lèi)自古以來(lái)孜孜以求的一個(gè)社會(huì)理想。繼黨的十五大提出“建設(shè)社會(huì)主義法治國(guó)家”后，黨的十六屆四中全會(huì)又提出了“構(gòu)建社會(huì)主義和諧社會(huì)”的新命題。所謂社會(huì)主義和諧社會(huì)，主要是指一種美好的社會(huì)狀態(tài)和社會(huì)理想，即全體人民各盡其能、各得其所而又和諧相處的社會(huì)，涵蓋了人與人、人與社會(huì)、人與自然這三方面的辯證關(guān)系。這一新的執(zhí)政理念和方略，是我們黨堅(jiān)持中國(guó)特色社會(huì)主義道路、用發(fā)展著的馬克思主義指導(dǎo)新的社會(huì)實(shí)踐的重大成果，也是中國(guó)共產(chǎn)黨執(zhí)政理念的重要升華，更是我們黨解決發(fā)展困境、應(yīng)對(duì)時(shí)代挑戰(zhàn)的重大戰(zhàn)略舉措。 中共中央總書(shū)記胡錦濤同志深刻指出，我們所要建設(shè)的社會(huì)主義和諧社會(huì)，應(yīng)該是民主法治、公平正義、誠(chéng)信友愛(ài)、充滿活力、安定有序、人與自然和諧相處的社會(huì)。胡錦濤總書(shū)記之所以把“民主法治”放在六大特征之首，是因?yàn)椴粌H和諧社會(huì)必然是民主社會(huì)、法治社會(huì)，而且只有在一個(gè)崇尚民主、奉行法治的社會(huì)，構(gòu)建和諧社會(huì)的其它要素才能得到真正實(shí)現(xiàn)。從這個(gè)意義上講，和諧社會(huì)的所有問(wèn)題都必然歸結(jié)于法治問(wèn)題，或者與法治密不可分，法治在構(gòu)建和諧社會(huì)中具有至關(guān)重要的基礎(chǔ)性作用，因而必須依靠法治來(lái)推動(dòng)和諧社會(huì)的構(gòu)建，，依靠法治來(lái)引導(dǎo)和諧社會(huì)的發(fā)展，依靠法治來(lái)保障和諧社會(huì)的實(shí)現(xiàn)。 法治，即法律之治，是任何文明社會(huì)的基石和保障，更是實(shí)現(xiàn)和諧主張的必然要求。換言之，法律本身就是追求社會(huì)和諧的產(chǎn)物，和諧社會(huì)的性質(zhì)內(nèi)在地包含著對(duì)于法治的要求，和諧社會(huì)是在法治基礎(chǔ)上實(shí)現(xiàn)的更高的社會(huì)發(fā)展階段。就我國(guó)當(dāng)下的情形而言，只有努力探索法治視野下構(gòu)建和諧社會(huì)的基本路徑，切實(shí)筑牢法治基礎(chǔ)，積極推動(dòng)法治國(guó)家建設(shè)，才能從根本上實(shí)現(xiàn)構(gòu)建社會(huì)主義和諧社會(huì)的目標(biāo)。為此，必須筑牢民主的法治基礎(chǔ)，筑牢尊重和保障權(quán)利和人權(quán)的法治基礎(chǔ)，筑牢激發(fā)活力和創(chuàng)造精神的法治基礎(chǔ)，筑牢公正合理協(xié)調(diào)利益的法治基礎(chǔ)，筑牢確保社會(huì)信用的法治基礎(chǔ)，筑牢人與自然和諧發(fā)展的法治基礎(chǔ)，筑牢輿論導(dǎo)向和監(jiān)督的法治基礎(chǔ)，筑牢反腐倡廉的法治基礎(chǔ)，筑牢定分止?fàn)�、化解糾紛的法治基礎(chǔ)，筑牢和諧世界的法治基礎(chǔ)。

    It is a social ideal for many people to realize harmonious society. After proposing "the construction socialism country under the rule of law", the Communist Party of China, by the huge political wisdom and the theory courage, also proposed in party’s 16 sessions of Fourth Plenary Session "constructs the socialism harmonious society". The so-called socialism harmonious society mainly refers to one kind of happy social condition and social ideal, namely all people can take their proper place in the society. It has covered three aspects dialectical relations, that is to say, the human and the human, the human and social, the human and the nature.
