【摘要】：隨著"依法治校"理念不斷深入,現(xiàn)代高校法治治理日益重要且已被提上議程,而高校章程是現(xiàn)代高校法治治理的重要載體,因此高校章程自身法治化建設(shè)凸顯重要性和關(guān)鍵性。盡管福建省部分高校已經(jīng)創(chuàng)制了正式章程或章程(草案),但不論是在高等教育管理實踐中,還是在維護(hù)校內(nèi)師生主體合法權(quán)益方面,其發(fā)揮作用甚微�；诖�,文章通過對福建省部分高校章程文本的分析,從效力位階、實體內(nèi)容、程序操作以及監(jiān)督實施層面找到問題所在,針對這些問題以及結(jié)合它們產(chǎn)生的原因,最終提出了現(xiàn)代高校章程法治化建設(shè)困境的突破路徑。
[Abstract]:With the deepening of the concept of "administering the school according to law", the rule of law governance in modern colleges and universities is becoming more and more important and has been put on the agenda, and the articles of association of colleges and universities are an important carrier of the rule of law in modern colleges and universities, so the construction of the rule of law in colleges and universities itself is of great importance and key. Although some colleges and universities in Fujian Province have created formal articles of association or articles of association (draft), they play little role in the practice of higher education management and in safeguarding the legitimate rights and interests of teachers and students. Based on this, through the analysis of the articles of association of some colleges and universities in Fujian Province, this paper finds out the problems from the level of effectiveness, entity content, program operation and supervision and implementation. In view of these problems and their causes, this paper finally puts forward the breakthrough path of the dilemma of the construction of the rule of law in modern colleges and universities.
