【摘要】：馬克思主義法治理論中國化,是在總結(jié)中國共產(chǎn)黨領(lǐng)導(dǎo)治理國家與社會的實(shí)踐經(jīng)驗(yàn),并使之上升為理論,豐富和發(fā)展馬克思主義法治理論,形成中國化的馬克思主義法治理論,是馬克思主義法學(xué)中國化的重要組成部分。馬克思主義法治理論中國化,就是運(yùn)用馬克思主義基本原理,將馬克思主義法治理論,運(yùn)用于中國法治建設(shè)實(shí)踐的過程。馬克思主義法治理論為中國的法治建設(shè)提供了重要的理論指導(dǎo),而中國共產(chǎn)黨人在堅(jiān)持不懈的社會主義法治建設(shè)中,也在不斷地豐富、完善馬克思主義的法治理論。在這一過程中,我們正確解答了國家與政黨、政黨與法律、政黨與人民、人民與法律、人民與國家等的關(guān)系問題,探尋了國家實(shí)現(xiàn)長治久安的治理方式,摸索了實(shí)現(xiàn)人的自由與解放的基本路徑。 馬克思主義法治理論中國化的歷史進(jìn)程,是一個漫長的過程,也經(jīng)受過像“文化大革命”那樣的很多嚴(yán)重挫折,有著深重的歷史教訓(xùn)。但是在馬克思主義法治理論中國化的過程中,我們黨始終堅(jiān)持住了馬克思主義的基本立場和方法,取得了一些基本經(jīng)驗(yàn)。首先,正確地解決了黨的領(lǐng)導(dǎo)、人民當(dāng)家作主與依法治國三者之間的關(guān)系。其次,創(chuàng)造性地賦予了馬克思主義法治理論以民族特性和民族氣派。通過黨的特殊的群眾動員機(jī)制使馬克思主義法治理論真正地與中國社會的法治實(shí)踐相結(jié)合,并且得到不斷的發(fā)展。同時,隨著時代的不斷變化,不斷賦予了馬克思主義法治以鮮明的時代特色,使它與時俱進(jìn)不斷豐富和發(fā)展,更好地服務(wù)于社會主義建設(shè)。獲取了某些啟示:只有準(zhǔn)確理解馬克思主義法治思想的核心要義,順應(yīng)時代、立足中國法治實(shí)踐,推進(jìn)中國法治建設(shè);也只有正確處理馬克思主義法治基本原理與傳統(tǒng)法治資源的關(guān)系,才能發(fā)展馬克思主義法治理論;只有敢于并善于批判繼承西方法治資源,才能在交鋒和論爭中加強(qiáng)和完善自身。 通過對馬克思、恩格斯和列寧等經(jīng)典作家法治思想的學(xué)習(xí)與吸收,經(jīng)過近90年的發(fā)展,馬克思主義法治理論的中國化取得了豐碩的成果:毛澤東思想中的人民民主專政和人民民主法制理論和中國特色社會主義法治理論體系。中國特色社會主義法治理論體系,體現(xiàn)在鄧小平理論、“三個代表”重要思想、科學(xué)發(fā)展觀與和諧社會建設(shè)等關(guān)于民主與法治建設(shè)的重要理論中,其中“在科學(xué)發(fā)展觀指導(dǎo)下,堅(jiān)持黨的領(lǐng)導(dǎo)、人民當(dāng)家作主、依法治國的有機(jī)統(tǒng)一”是中國化的馬克思主義法治理論核心中的核心。 馬克思主義法治理論中國化的問題,是一個永恒的主題。我們已經(jīng)進(jìn)入到了社會主義民主法治建設(shè)新時期,面臨著新形勢新任務(wù)新課題的考驗(yàn)。環(huán)視當(dāng)前的中國化馬克思主義法治理論,無論是在內(nèi)部理論結(jié)構(gòu)還是理論與其他社會存在的外部關(guān)系上,還存在諸多挑戰(zhàn),比如:馬克思主義法治理論尚未完全展開,一些基本問題有待深入解決;法律的實(shí)踐性對馬克思主義法治理論的進(jìn)化提出了更高的要求;中國化的馬克思主義法治理論在時代發(fā)展的驅(qū)動下,面臨重大突破的壓力等。馬克思主義法治理論中國化,是馬克思主義系統(tǒng)性工程中重要的一環(huán)。作為系統(tǒng)工程,在中國化的馬克思主義法治理論建設(shè)過程中,我們必須根據(jù)中心工作,選準(zhǔn)、瞄準(zhǔn)建設(shè)目標(biāo),有重點(diǎn)、有層次的推進(jìn),將國家的法治狀況、社會的法治秩序、民眾的法治意識提升到一個新的境界,以實(shí)現(xiàn)富民強(qiáng)國、長治久安的美好愿景。
