【摘要】： 中國共產黨自成立之日起就十分關注工人階級的利益,重視勞動立法工作,領導工人進行了堅持不懈的斗爭。新民主主義革命時期中國共產黨的勞動立法運動雖然一波三折,經歷曲折,但也取得了重大成就,為我們留下了寶貴的經驗教訓。本文以新民主主義革命時期的歷史為線索,梳理中國共產黨在國民革命、土地革命、抗日戰(zhàn)爭和解放戰(zhàn)爭時期的勞動立法進程,分析其成敗得失,以期為新時期的、新形勢下的勞動立法工作提供借鑒。 全文共分三部分。第一部分主要介紹中國共產黨領導的中國工人階級早期勞動立法斗爭。文章從分析中國工人階級的產生及特點入手,著重介紹了中國共產黨的早期勞動立法主張。第二部分在闡述國民革命、土地革命、抗日戰(zhàn)爭和解放戰(zhàn)爭時期四個不同階段黨領導勞動立法工作的背景、指導政策、機構設置和相關法律文件的基礎上,分析概括了不同階段勞動立法工作的特點和成就。第三部分全面總結新民主主義革命時期勞動立法的特點,從而得到現實啟示:勞動立法要順應時代的發(fā)展變化,不斷調整其內容;勞動立法應該注重調整勞資關系;勞動立法要真正保護勞動者的合法權益;勞動立法應該關注工會的重大作用。
[Abstract]:Since its founding, the Communist Party of China has paid close attention to the interests of the working class, attached importance to the work of labor legislation, and led the workers in their persistent struggle. In the period of the new democratic revolution, the labor legislation movement of the Communist Party of China has experienced twists and turns, but it has also made great achievements, leaving us valuable experience and lessons. Taking the history of the new democratic revolution period as a clue, this paper combs the labor legislation process of the Communist Party of China in the period of the national revolution, the agrarian revolution, the anti-Japanese war and the liberation war, and analyzes its success and failure, with a view to making it a new period. The labor legislation work under the new situation provides the reference. The full text is divided into three parts. The first part mainly introduces the early labor legislation struggle of the Chinese working class led by the Communist Party of China. This article begins with the analysis of the emergence and characteristics of the Chinese working class, and emphatically introduces the early labor legislation propositions of the Communist Party of China. In the second part, on the basis of expounding the background, guiding policy, institutional setup and relevant legal documents of the Party leading labor legislation in the four different stages of the National Revolution, the Agrarian Revolution, the War of Resistance against Japan and the War of Liberation, The characteristics and achievements of different stages of labor legislation are analyzed and summarized. The third part summarizes the characteristics of labor legislation in the period of new democratic revolution and gets the realistic enlightenment: Labor legislation should adapt to the development of the times and adjust its content constantly, the labor legislation should pay attention to the adjustment of labor-capital relations, and the labor legislation should adjust the labor-capital relations. Labor legislation should really protect the legitimate rights and interests of labourers; Labor legislation should pay attention to the important role of trade unions.
