論我國(guó)法治政府建設(shè)的模式選擇

【摘要】:我國(guó)的法治政府建設(shè)取得了重要進(jìn)展,但也面臨不少困難和問(wèn)題。建設(shè)法治政府的歷程和推進(jìn)法治政府的方式表明,我國(guó)采取的是行政主導(dǎo)型的法治政府建設(shè)模式。行政主導(dǎo)型模式存在合法性不足、缺乏充分的外部監(jiān)督等缺陷,難以推動(dòng)法治政府建設(shè)取得更大實(shí)效。而議會(huì)主導(dǎo)型模式和自然演進(jìn)模式,在我國(guó)尚不具備現(xiàn)實(shí)可行性。 公共治理的興起,呼喚建立主體多元化、方式民主化、管理協(xié)作化的上下互動(dòng)的新型治理模式,要求政府從“統(tǒng)治”轉(zhuǎn)向“治理”,實(shí)現(xiàn)對(duì)社會(huì)的“善治”。這對(duì)我國(guó)法治政府建設(shè)模式的選擇有許多有益的啟示。行政主導(dǎo)型的單一模式,應(yīng)當(dāng)向“黨委領(lǐng)導(dǎo),人大引導(dǎo),政府實(shí)施,多方監(jiān)督,公眾參與”的綜合模式轉(zhuǎn)變。 法治政府建設(shè)的綜合模式,既吸收了行政主導(dǎo)型、議會(huì)主導(dǎo)型和自然演進(jìn)型三種單一模式的優(yōu)點(diǎn),又回避了其缺點(diǎn)。綜合模式中,強(qiáng)調(diào)了黨委的領(lǐng)導(dǎo)作用,有利于充分調(diào)動(dòng)各種力量參與法治政府建設(shè);強(qiáng)調(diào)了人大的引導(dǎo)作用,有利于彌補(bǔ)行政主導(dǎo)型模式合法性不足的缺陷;強(qiáng)調(diào)了政府是法治政府建設(shè)的實(shí)施主體,有利于明確政府的責(zé)任和保持其參與法治政府建設(shè)的積極性和主動(dòng)性;強(qiáng)調(diào)了政協(xié),司法機(jī)關(guān)等多種主體的監(jiān)督,有利于對(duì)法治政府建設(shè)形成全方位的監(jiān)督體系;還特別強(qiáng)調(diào)了公共參與的重要作用。 法治政府建設(shè)的綜合模式,是符合我國(guó)政治體制、符合我國(guó)現(xiàn)實(shí)國(guó)情、符合公共治理發(fā)展趨勢(shì)的更為合理的選擇。
[Abstract]:China's rule of law government has made important progress, but it also faces many difficulties and problems. The course of the construction of the government ruled by law and the way to promote the government by law show that our country adopts the administrative-led model of the construction of the government ruled by law. The lack of legitimacy and adequate external supervision makes it difficult to promote the construction of a government ruled by law to achieve more practical results. However, the parliamentary dominant model and the natural evolution model are not feasible in our country. The rise of public governance calls for the establishment of a new type of governance model, which is characterized by diversification of subjects, democratization of ways and cooperation of management. It requires the government to change from "rule" to "governance" and to realize "good governance" to society. This has many beneficial enlightenment to our country rule of law government construction mode choice. The single mode of administration-leading should be changed to the comprehensive mode of "Party committee leading, people's Congress guiding, government implementing, multi-party supervision and public participation". The comprehensive model of the construction of government ruled by law not only absorbs the advantages of three single modes, namely, executive-led, parliamentary-led and naturally evolving, but also evades its shortcomings. In the comprehensive model, the leading role of the party committee is emphasized, which is beneficial to fully mobilize all kinds of forces to participate in the construction of the government ruled by law, and the guiding role of the people's Congress is emphasized, which is helpful to make up for the deficiency of the legitimacy of the administrative leading model. It is emphasized that the government is the main body of the construction of the government under the rule of law, which is helpful to clarify the responsibility of the government and maintain its enthusiasm and initiative to participate in the construction of the government by law It emphasizes the supervision of CPPCC, judicial organs and other subjects, which is conducive to forming an all-round supervision system for the construction of a government ruled by law, and especially emphasizes the important role of public participation. The comprehensive model of the construction of the government ruled by law is a more reasonable choice in line with the political system of our country, the reality of our country, and the development trend of public governance.
