法治供給側(cè)改革下的檢察改革

【摘要】：法治供給側(cè)改革的核心理念在于提高供給質(zhì)量,擴(kuò)大有效供給,推進(jìn)結(jié)構(gòu)調(diào)整,矯正要素配置,最終目的是為了更有效地滿足社會(huì)需求。供給是法治供給側(cè)改革的基本范疇與邏輯起點(diǎn);提升法治供給是法治供給側(cè)改革的基本目標(biāo);優(yōu)化要素配置是法治供給側(cè)改革的基本途徑。法治需求的樣態(tài)主要體現(xiàn)在:對(duì)規(guī)則和秩序的需求、對(duì)意義和價(jià)值的需求以及對(duì)公共交往和生活方式的需求。法治供給側(cè)改革的基本要求主要有以下五點(diǎn):第一,立法領(lǐng)域中的科學(xué)性;第二,執(zhí)法領(lǐng)域中的嚴(yán)格性;第三,司法領(lǐng)域中的公正性;第四,法律監(jiān)督領(lǐng)域中的有效性。檢察供給側(cè)改革,是通過對(duì)價(jià)值要素、制度要素、人員要素以及技術(shù)要素的有效配置,不斷完善檢察管理體制和檢察權(quán)運(yùn)行機(jī)制,進(jìn)而實(shí)現(xiàn)建立公正高效權(quán)威檢察制度的目標(biāo)。
[Abstract]:The core idea of supply-side reform of rule of law is to improve supply quality, expand effective supply, promote structural adjustment, and correct the allocation of elements. The ultimate purpose is to meet social demand more effectively. Supply is the basic category and logical starting point of the supply-side reform of the rule of law; promoting the supply of the rule of law is the basic goal of the supply-side reform of the rule of law; optimizing the allocation of elements is the basic way of supply-side reform of the rule of law. The demand for the rule of law is mainly embodied in the demand for rules and order, the demand for meaning and value, and the demand for public communication and lifestyle. The basic requirements of the supply-side reform of the rule of law are as follows: first, the scientific nature in the legislative field; second, the strictness in the field of law enforcement; third, the impartiality in the judicial field; and fourth, the effectiveness in the field of legal supervision. The reform of procuratorial supply-side is to improve the procuratorial management system and the running mechanism of procuratorial power through the effective allocation of value elements, institutional elements, personnel elements and technical elements, and then realize the goal of establishing a fair and efficient procuratorial system of authority.
