【摘要】：和諧社會(huì)是追求民主法治、公平正義的社會(huì),在這樣一種價(jià)值訴求下,立法公正得到越來越多的關(guān)注,同時(shí)也被賦予了更豐富的時(shí)代精神,即立法公正要求所立之法具有科學(xué)性、民主性、本土性和全球性。如果說,和諧社會(huì)的構(gòu)建賦予了立法公正上述時(shí)代精神,那么,立法公正對(duì)和諧社會(huì)中的制度設(shè)計(jì)也起著積極作用,即立法公正可以使制度的構(gòu)建更加科學(xué),使制度的實(shí)質(zhì)更加理性,使制度的形式更加民主,使制度的變遷更能與時(shí)俱進(jìn)。
[Abstract]:Harmonious society is a society that pursues democracy and rule of law, fairness and justice. Under this kind of value demand, legislative justice gets more and more attention, and it is also endowed with a richer spirit of the times. That is, the legislation requires the law to be scientific, democratic, local and global. If the construction of a harmonious society has given the spirit of the era of legislative justice, then the legislative justice also plays a positive role in the design of the system in the harmonious society, that is, the legislative justice can make the construction of the system more scientific. Make the essence of the system more rational, make the form of the system more democratic, make the system change with the times.
