【摘要】：法治體現(xiàn)了人類社會共同的追求和價值目標(biāo),蘊含著平等,反對特權(quán),反對濫用權(quán)力的基本理念。腐敗滋生于權(quán)力,又寄生于權(quán)力,各種腐敗行為是公共權(quán)力的濫用和異化,實際上破壞著權(quán)利平等、權(quán)力制約和公平正義的法治原則。法治蘊含權(quán)力約束、保障權(quán)利和反對人治任意的價值理念,腐敗意味著破壞法治、踐踏法治和阻滯法治推進(jìn)的因素。因此,法治與反腐之間存在作用與反作用的關(guān)系。一定程度上而言,腐敗興,則法治亡;法治興,則腐敗亡。兩者的邏輯關(guān)系在于法治助力推進(jìn)反腐,反腐又有助于法治的不斷完善。
[Abstract]:The rule of law embodies the common pursuit and value goal of human society, and contains the basic idea of equality, opposition to privilege and abuse of power. Corruption is born in power and parasitic on power. All kinds of corruption is the abuse and alienation of public power, which actually destroys the principle of rule of law of equality of rights, restriction of power and fairness and justice. The rule of law contains power constraints, safeguards rights and opposes arbitrary values of rule by man. Corruption means destroying the rule of law, trampling on the rule of law and blocking the advancement of the rule of law. Therefore, there is a relationship between the rule of law and anti-corruption. To a certain extent, corruption, the rule of law, corruption. The logical relationship between the two is that the rule of law helps to promote anti-corruption, and anti-corruption helps to improve the rule of law.
