論我國(guó)行政決策民主機(jī)制的形成與發(fā)展

【摘要】: 經(jīng)過(guò)30余年的發(fā)展,我國(guó)行政決策民主機(jī)制逐漸回應(yīng)了社會(huì)經(jīng)濟(jì)、政治和文化的需要,日益滿足了人民不斷增長(zhǎng)的政治參與和民主表達(dá)權(quán)利的需要。但現(xiàn)存的行政決策民主機(jī)制在運(yùn)轉(zhuǎn)中也存在諸多問(wèn)題。本文主要從我國(guó)行政決策民主機(jī)制的形成入手,通過(guò)對(duì)新中國(guó)成立以來(lái),中國(guó)行政決策民主機(jī)制形成的歷史過(guò)程進(jìn)行分析,從中歸納出中國(guó)行政決策民主機(jī)制的主要內(nèi)容,并且對(duì)行政決策民主機(jī)制的未來(lái)發(fā)展趨勢(shì)進(jìn)行展望。 論文包括緒論、正文三個(gè)部分和結(jié)論,下面介紹一下論文的結(jié)構(gòu)框架:緒論,在緒論部分中,主要說(shuō)明選題的寫(xiě)作意義、研究方法以及核心概念解析等幾個(gè)問(wèn)題。 第一部分,我國(guó)行政決策民主機(jī)制的形成過(guò)程。在這一部分中,主要介紹新中國(guó)成立以來(lái),我國(guó)行政決策民主機(jī)制形成和發(fā)展過(guò)程。按照歷史發(fā)展的脈絡(luò)進(jìn)行劃分,我國(guó)行政決策民主機(jī)制的形成與發(fā)展經(jīng)歷了五個(gè)主要的發(fā)展過(guò)程,即(1)行政決策民主機(jī)制未獨(dú)立化階段;(2)行政決策民主機(jī)制初步呈現(xiàn)階段;(3)行政決策民主化科學(xué)化發(fā)展階段;(4)行政決策民主步入戰(zhàn)略地位階段;(5)行政決策民主化機(jī)制深化和常規(guī)化階段。同時(shí)指出了黨的決策與行政民主決策的緊密關(guān)系,以及我國(guó)行政決策民主化進(jìn)程的特點(diǎn):外在性動(dòng)力和內(nèi)在性動(dòng)力同時(shí)作用、形式化和實(shí)質(zhì)化的矛盾并存。 第二部分,我國(guó)行政決策民主機(jī)制的基本內(nèi)容,主要表現(xiàn)為政務(wù)公開(kāi)制度、行政立法參與制度、公共決策公示和聽(tīng)證制度、專家咨詢和論證制度和內(nèi)部行政民主制度。 第三部分,我國(guó)行政決策民主機(jī)制的發(fā)展方向。通過(guò)對(duì)我國(guó)行政決策民主機(jī)制發(fā)展的歷史地回顧,以及分析行政決策民主機(jī)制主要內(nèi)容的分析,筆者認(rèn)為,我國(guó)行政決策民主機(jī)制的發(fā)展應(yīng)該注意和解決四個(gè)問(wèn)題:一是強(qiáng)化法律規(guī)范對(duì)行政決策的約束和監(jiān)督功能,既重視外部行政法的作用,同時(shí)發(fā)揮內(nèi)部行政法的建設(shè)功能。二是健全行政程序?qū)Q策民主的規(guī)范作用,不僅重視形式法治上的行政程序,尤其要重視實(shí)質(zhì)民主上的行政程序。三是建立行政決策者的責(zé)任機(jī)制,包括增進(jìn)公務(wù)人員的專業(yè)知識(shí)能力、約束行政決策的自由裁量權(quán)、將成本效益分析方法引入行政決策過(guò)程、建立聯(lián)合行政決策機(jī)制。四是強(qiáng)化公民社會(huì)的公共責(zé)任,在行政機(jī)關(guān)及其工作人員的決策責(zé)任之外,專家和咨詢委員會(huì)也必須擔(dān)負(fù)起行政決策責(zé)任,在公民社會(huì)里,公民也要對(duì)行政決策的參與負(fù)起責(zé)任,這與他們憲法上的言論自由和監(jiān)督權(quán)利并不矛盾。 結(jié)論部分,對(duì)行政決策民主機(jī)制進(jìn)行總結(jié),重點(diǎn)指出我國(guó)行政決策民主機(jī)制的重要作用,明確我國(guó)行政決策民主機(jī)制的未來(lái)取向。
[Abstract]:After more than 30 years of development, the democratic mechanism of administrative decision-making in our country has gradually responded to the needs of social economy, politics and culture, and has increasingly satisfied the increasing needs of the people's political participation and democratic expression rights. However, there are many problems in the operation of the existing democratic mechanism of administrative decision-making. Starting with the formation of the democratic mechanism of administrative decision-making in China, this paper analyzes the historical process of the formation of the democratic mechanism of administrative decision-making in China since the founding of New China, and concludes the main contents of the democratic mechanism of administrative decision-making in China. And carries on the prospect to the administration decision-making democratic mechanism in the future development trend. The paper includes introduction, three parts of the text and conclusions. The following is the introduction. In the introduction, it mainly explains the significance of the topic, the research methods and the analysis of the core concepts. The first part, the forming process of democratic mechanism of administrative decision in our country. In this part, it mainly introduces the formation and development of the democratic mechanism of administrative decision-making in China since the founding of New China. According to the historical development, the formation and development of the democratic mechanism of administrative decision-making in China has undergone five main development processes: (1) the democratic mechanism of administrative decision-making is not independent; (2) the democratic mechanism of administrative decision-making is at a preliminary stage; (3) the stage of scientific development of democratization of administrative decision making; (4) the stage of administrative decision-making democracy stepping into the strategic position; (5) the stage of deepening and regularizing the mechanism of democratization of administrative decision making. At the same time, it points out the close relationship between the party's decision making and the administrative democratic decision making, and the characteristics of the democratization process of our country's administrative decision making: the extrinsic motive force and the internal motive force act simultaneously, and the contradiction of formalization and materialization coexist. The second part, the basic content of the democratic mechanism of administrative decision in our country, mainly shows as the system of open government affairs, the system of participation in administrative legislation, the system of publicity and hearing of public decision making, the system of expert consultation and demonstration and the system of internal administrative democracy. The third part, the development direction of our country administration decision-making democratic mechanism. Based on the historical review of the development of the democratic mechanism of administrative decision-making in China and the analysis of the main contents of the democratic mechanism of administrative decision-making, the author holds that, Four problems should be paid attention to and solved in the development of democratic mechanism of administrative decision in our country. Firstly, we should strengthen the restriction and supervision function of legal norm to administrative decision, and attach importance to the function of external administrative law, at the same time bring into play the construction function of internal administrative law. The second is to perfect the normative function of administrative procedure on decision-making democracy, not only to attach importance to the administrative procedure in the form of the rule of law, but also to the administrative procedure in the substantive democracy in particular. The third is to establish the responsibility mechanism of the administrative decision makers, including enhancing the professional knowledge of public servants, restricting the discretion of administrative decisions, introducing the cost-benefit analysis method into the administrative decision-making process, and establishing the joint administrative decision-making mechanism. Fourth, to strengthen the public responsibility of civil society. In addition to the decision-making responsibilities of administrative organs and their staff, experts and advisory committees must also assume responsibility for administrative decision-making, and in civil society, Citizens are also responsible for their participation in administrative decisions, which is not inconsistent with their constitutional rights to freedom of speech and oversight. The conclusion part summarizes the democratic mechanism of administrative decision-making, points out the important role of the democratic mechanism of administrative decision-making in China, and clarifies the future orientation of the democratic mechanism of administrative decision-making in China.
