【摘要】：在目前的法治進(jìn)程中，信訪制度自身的特點(diǎn)和現(xiàn)實(shí)的需求決定了信訪制度在憲政體制中有存在的合理性。信訪制度在制度設(shè)計(jì)上是我國(guó)基本制度在效能不足時(shí)的一種輔助制度。但現(xiàn)階段由于基本制度的不完善、信訪責(zé)任追究機(jī)制和信訪人的心理因素等現(xiàn)實(shí)的需求，對(duì)信訪制度的定位過(guò)高，信訪制度在一定程度上成為了權(quán)利救濟(jì)的主要制度，并因此導(dǎo)致了功能錯(cuò)位、成本超出預(yù)期等一系列的問(wèn)題。信訪制度應(yīng)作為基本制度的輔助性制度而存在，承擔(dān)推動(dòng)基本制度完善的功能。信訪制度的完善、信訪困境的消除，從長(zhǎng)遠(yuǎn)來(lái)看，功在信訪制度之外，應(yīng)努力推動(dòng)基本制度的完善，，剝離信訪制度所不應(yīng)負(fù)擔(dān)的功能。從短期來(lái)看，應(yīng)以信訪理念的加強(qiáng)、信訪制度程序化的加強(qiáng)和民主監(jiān)督的完善為路徑。
[Abstract]:In the process of ruling by law at present, the characteristics of petition system itself and the demand of reality determine the rationality of the existence of petition system in constitutional system. The system of letters and visits is an auxiliary system in our country when its efficiency is insufficient. However, due to the imperfections of the basic system, the mechanism of investigating the responsibility for the petition and the psychological factors of the petitioners, and so on, the position of the petition system is too high. To some extent, the petition system has become the main system of right relief. And thus leading to functional dislocation, cost than expected and a series of problems. The petition system should exist as the auxiliary system of the basic system and assume the function of promoting the perfection of the basic system. In the long run, the improvement of petition system and the elimination of petition predicament should push forward the perfection of the basic system and peel off the function that should not be borne by the petition system in the long run. In the short term, it is necessary to strengthen the concept of petition, strengthen the procedure of petition system and perfect democratic supervision.
