【摘要】：中國傳統(tǒng)法制的現(xiàn)代轉(zhuǎn)型,不僅僅是單純的法律轉(zhuǎn)型問題。古往今來,法治時代的開創(chuàng),誠然需要精通法律的法學家來具體設(shè)計和操作,但更需要一個偉大開明的政治家的引領(lǐng)和開創(chuàng)。鄧小平作為偉大的政治家,其關(guān)于社會主義法治的論述,內(nèi)容非常豐富,形成了自己獨特的法制思想。研究鄧小平法制思想,結(jié)合研究中國傳統(tǒng)法制的現(xiàn)代轉(zhuǎn)型,對推進民主政治體制改革,建設(shè)社會主義法治國家,具有重要的理論指導意義。 文章始終堅持馬克思主義唯物史觀,遵從歷史發(fā)展軌跡,首先回顧了中國傳統(tǒng)法制的歷程和特點,指出了傳統(tǒng)法制面臨的現(xiàn)代困境。接著論述了毛澤東對傳統(tǒng)法制現(xiàn)代轉(zhuǎn)型初步探索中的歷史經(jīng)驗,重點研究了鄧小平法制思想與中國傳統(tǒng)法制的現(xiàn)代轉(zhuǎn)型,進而探討了鄧小平法制思想在中國傳統(tǒng)法制現(xiàn)代轉(zhuǎn)型進程中的歷史方位。 文章從政治學和法學相結(jié)合的角度,認真梳理了中國傳統(tǒng)法制的歷程、特征及其現(xiàn)代困境,系統(tǒng)論述了中國傳統(tǒng)法制現(xiàn)代轉(zhuǎn)型的歷史進程�？茖W評價了鄧小平法制思想在傳統(tǒng)法制現(xiàn)代轉(zhuǎn)型進程中的歷史方位,指出鄧小平法制思想,是以馬克思主義法學理論為根本指導原則,經(jīng)過中國革命與建設(shè)實踐檢驗的產(chǎn)物,是馬克思主義法學理論的中國化;是對中國傳統(tǒng)法制文化的繼承和超越,是中國傳統(tǒng)法制文化的現(xiàn)代化;以其樸實的語言和對人民群眾普法與法學教育的重視,推動了馬克思主義法治理論的大眾化。
[Abstract]:The modern transformation of Chinese traditional legal system is not only a question of legal transformation. Through the ages, the creation of the rule of law era, it is necessary to master the legal jurists to design and operate, but also needs a great enlightened statesman to lead and create. As a great politician, Deng Xiaoping's exposition on socialist rule of law is very rich in content and formed his own unique legal thought. It is of great theoretical significance to study Deng Xiaoping's thought of legal system and the modern transformation of Chinese traditional legal system to promote the reform of democratic political system and to build a socialist country ruled by law. The article always adheres to Marxist historical materialism and follows the track of historical development. Firstly, it reviews the history and characteristics of Chinese traditional legal system, and points out the modern dilemma that the traditional legal system is facing. Then it discusses Mao Zedong's historical experience in exploring the modern transformation of traditional legal system, focusing on Deng Xiaoping's legal thought and the modern transformation of Chinese traditional legal system. Then it discusses the historical orientation of Deng Xiaoping's legal thought in the process of modern transformation of Chinese traditional legal system. From the angle of the combination of political science and law, the paper combs the course, characteristics and modern predicament of Chinese traditional legal system, and systematically discusses the historical process of modern transformation of Chinese traditional legal system. This paper scientifically evaluates the historical orientation of Deng Xiaoping's legal thought in the course of the transformation of the traditional legal system and modern society, and points out that Deng Xiaoping's legal thought is the product of the Marxist legal theory as the fundamental guiding principle and has been tested by the Chinese revolution and construction practice. It is the Sinicization of Marxist legal theory. It is the inheritance and transcendence of Chinese traditional legal culture, the modernization of Chinese traditional legal culture, and the popularization of Marxist theory of rule of law with its simple language and the importance of popularizing law and law education among the masses.
