【摘要】：法治作為治國方略與國家治理密切關(guān)聯(lián)。現(xiàn)代法治就是通過一種治理形成自組織協(xié)調(diào)重建國家社會的新結(jié)構(gòu)與秩序,且這種國家治理比傳統(tǒng)的統(tǒng)治更能適應(yīng)社會環(huán)境,為各國提升治理的有效性并超越"政府失靈與市場失靈"的困境提供了新的視域,從而使國家社會的良性運行秩序得以存在并可持續(xù)。在當(dāng)前全球歷史大變革中,現(xiàn)代法治將其基本的價值觀念、制度和理性秩序構(gòu)成的一些核心要素稟賦于國家治理之中,特別是在全面深化改革中用法治引領(lǐng)改革、以法治的思維理念和程序推進(jìn)改革,促進(jìn)國家治理逐步達(dá)到理想的良法善治狀態(tài),使現(xiàn)代法治的價值進(jìn)一步彰顯。
[Abstract]:The rule of law as a strategy of governing the country is closely related to national governance. The modern rule of law is to form a new structure and order of self-organization and coordination to rebuild the national society through a kind of governance, and this kind of state governance is more adaptable to the social environment than the traditional rule. It provides a new horizon for countries to enhance the effectiveness of governance and transcend the dilemma of "government failure and market failure", so that the benign operating order of national society can exist and be sustainable. In the current global historical changes, the modern rule of law has endowed the core elements of its basic values, institutions and rational order in the governance of the country, especially in the overall deepening of the reform, leading the reform by the rule of law. The idea and procedure of the rule of law are used to promote the reform, to promote the governance of the country gradually to achieve the ideal state of good law and good governance, and to make the value of the modern rule of law manifest further.
