【摘要】：堅(jiān)持依法治體,加強(qiáng)體育法制建設(shè),不斷將體育工作納入法治軌道,是改革開放以來我國(guó)體育持續(xù)快速發(fā)展的根本保障。自我國(guó)《體育法》頒布實(shí)施以來,全國(guó)各省的體育法制建設(shè)均取得了重要進(jìn)展,也相應(yīng)的促進(jìn)了當(dāng)?shù)伢w育事業(yè)的快速發(fā)展。但是,隨著我國(guó)社會(huì)主義民主與法制建設(shè)的不斷加強(qiáng)和體育事業(yè)的發(fā)展,對(duì)體育法制工作也提出了更高的要求。在新時(shí)期下,我國(guó)各省市體育事業(yè)的發(fā)展對(duì)陜西省造成一定的沖擊,陜西省也更加重視體育法制的建設(shè),陜西省體育法制建設(shè)的現(xiàn)狀已不適應(yīng)體育事業(yè)發(fā)展的需要,必須要結(jié)合陜西的實(shí)際情況盡快進(jìn)行完善。 體育法制建設(shè)是目前陜西體育事業(yè)發(fā)展中的重要問題之一。也是當(dāng)前陜西省體育系統(tǒng)一項(xiàng)緊迫而又艱巨的任務(wù)。本論文以陜西省體育法制建設(shè)為主要研究對(duì)象,采用文獻(xiàn)資料法、專家訪談法、理論分析等方法,分析了建國(guó)60年來我國(guó)體育法制建設(shè)五個(gè)發(fā)展階段的不同特點(diǎn),重點(diǎn)研究了現(xiàn)階段陜西省體育法制建設(shè)的基本現(xiàn)狀和發(fā)展中存在的問題,并對(duì)陜西省體育法制建設(shè)的立法、執(zhí)法、守法和法律監(jiān)督情況,以及與其他省市在體育立法上的差距進(jìn)行了探討,研究發(fā)現(xiàn)陜西省體育法制建設(shè)還存在很多問題,得出如下結(jié)論：陜西體育立法滯后,質(zhì)量不高；缺乏體育法制的宣傳,形式不夠新穎；體育法學(xué)研究重視不夠,研究隊(duì)伍薄弱；體育執(zhí)法主體不明確,組織機(jī)構(gòu)不健全；陜西在學(xué)校體育立法、群眾體育立法和競(jìng)賽立法等方面存在缺陷。最后,為了更好地促進(jìn)陜西省體育事業(yè)的發(fā)展,結(jié)合社會(huì)主義市場(chǎng)經(jīng)濟(jì)條件下發(fā)展體育事業(yè)的要求,提出了陜西體育法制建設(shè)發(fā)展的對(duì)策建議：落實(shí)工作重點(diǎn),提高立法質(zhì)量；加大體育法制宣傳,增強(qiáng)體育法制觀念；充分利用地域優(yōu)勢(shì),加強(qiáng)體育法學(xué)科研隊(duì)伍,加強(qiáng)體育法學(xué)界的學(xué)術(shù)交流；規(guī)范體育執(zhí)法行為,建立有效的執(zhí)法監(jiān)督；完善學(xué)校體育、群眾體育等相關(guān)的立法體系。因此,以此構(gòu)建一個(gè)合理的、高效的體育法制運(yùn)行機(jī)制,對(duì)于逐步完善陜西省體育法制建設(shè)的快速發(fā)展具有重要的意義。
[Abstract]:It is the fundamental guarantee for the sustained and rapid development of sports in our country since the reform and opening to the outside world to adhere to the rule of law, strengthen the construction of sports legal system and bring sports work into the track of rule by law. Since the promulgation and implementation of the Sports Law in our country, the construction of sports legal system in all provinces of the country has made important progress, which has also promoted the rapid development of local sports undertakings. However, with the continuous strengthening of socialist democracy and legal system construction in China and the development of sports cause, higher requirements are put forward for sports legal work. In the new period, the development of sports in various provinces and cities in China has caused a certain impact on Shaanxi Province, and Shaanxi Province has paid more attention to the construction of sports legal system. The present situation of sports legal system construction in Shaanxi Province has not been adapted to the needs of the development of sports cause. Must be combined with the actual situation in Shaanxi as soon as possible to improve. The construction of sports legal system is one of the important problems in the development of Shaanxi sports. Also is a current Shaanxi Province sports system an urgent and arduous task. This paper takes the construction of sports legal system in Shaanxi Province as the main research object, using the methods of literature, expert interview and theoretical analysis, analyzes the different characteristics of the five stages of the legal construction of sports in China since the founding of the people's Republic of China in the past 60 years. This paper focuses on the basic status quo and problems in the development of sports legal system construction in Shaanxi Province at the present stage, and the legislation, law enforcement, law-abiding and legal supervision of the sports legal system construction in Shaanxi Province. As well as the gap with other provinces and cities in sports legislation, the study found that there are still many problems in the construction of sports legal system in Shaanxi Province, draw the following conclusions: Shaanxi sports legislation lag behind, the quality is not high; lack of sports legal publicity, The form is not new enough; the sports law research is not paid enough attention to, the research team is weak; the main body of sports law enforcement is not clear, the organization is not perfect; Shaanxi has defects in the school sports legislation, the mass sports legislation and the competition legislation and so on. Finally, in order to better promote the development of sports in Shaanxi Province, combined with the requirements of developing sports under the condition of socialist market economy, this paper puts forward the countermeasures and suggestions for the development of sports legal system in Shaanxi: carrying out the key points of work and improving the quality of legislation; Strengthen the publicity of sports legal system, strengthen the concept of sports legal system, make full use of regional advantages, strengthen the scientific research team of sports law, strengthen the academic exchange in sports law field, standardize sports law enforcement behavior, establish effective law enforcement supervision, perfect school sports, Mass sports and other related legislative system. Therefore, it is of great significance to construct a reasonable and efficient running mechanism of sports legal system for the gradual improvement of the rapid development of sports legal system in Shaanxi Province.
