【摘要】：生態(tài)環(huán)境的日益惡化,正威脅著人類賴以生存和發(fā)展的生存環(huán)境,加劇了人與自然之間的緊張關(guān)系,導致人類社會面臨著嚴重的生態(tài)危機。通過對生態(tài)危機的反思,我們看到人為因素在其中占了很大比重,如何緩解乃至克服生態(tài)危機,是當前人類面臨的一個重要課題。 人們只有首先樹立了正確的世界觀和價值觀,在人與人、人與自然之間建立起一種以尊重為基礎(chǔ)的和諧關(guān)系,全球性的環(huán)境危機才有望從根本上得到解決。本文擬通過對荀子生態(tài)環(huán)境保護思想的研究,揭示與發(fā)掘其當代價值,并將它融入到現(xiàn)代環(huán)境法治建設(shè)中,完成從傳統(tǒng)到現(xiàn)實的轉(zhuǎn)變,促進我國環(huán)境法治建設(shè)的完善,更好的實現(xiàn)人與自然之間的和諧。本文主要從以下幾個方面展開論述: 第一部分:荀子環(huán)保思想的獨特性。論文第一部分開宗明義,首先指出我國的傳統(tǒng)文化中包含著眾多的環(huán)境保護思想,對我國當代的法治建設(shè)有著不可磨滅的影響。簡要介紹中國的傳統(tǒng)生態(tài)思想對法治建設(shè)的影響,為下文詳細論述荀子環(huán)境保護思想對我國環(huán)境法治建設(shè)的影響做好鋪墊。隨后,介紹荀子環(huán)保思想的獨特性,論述之所以選擇荀子的環(huán)保思想的原因。 第二部分:荀子環(huán)保思想對環(huán)境立法的影響。從“天行有�！钡纳鷳B(tài)自然觀到“與天地參”的生態(tài)平衡觀,再到“制天命而用之”的生態(tài)發(fā)展觀,指導人們在認識把握自然規(guī)律的前提下,更好的發(fā)揮主觀能動性,合理利用自然。荀子的思想中蘊含著人與自然和諧相處的平等思想,對于我國的環(huán)境立法觀念有著良好的借鑒意義。我們在進行環(huán)境立法時要正確對待人與自然的關(guān)系,堅持可持續(xù)發(fā)展。 第三部分:荀子環(huán)保思想對環(huán)境執(zhí)法的影響。荀子通過“制天命而用之”、“圣人之制”、“以時禁發(fā)”思想,強調(diào)要堅定不移的按客觀規(guī)律辦事,反對統(tǒng)治者刻意追求“最高政績”,并明確管理職責的劃分。環(huán)境執(zhí)法問題一直是困擾我國環(huán)境保護問題的難點之一。各部門應各司其職,維護各自的獨立性。 第四部分:荀子環(huán)保思想對環(huán)境司法的影響。當代的“天人合一”,實際是指人類超越自身局限性,通過掌握或領(lǐng)悟宇宙間這一最高智慧、最高實體,通過對自身的反觀與體悟,達到與之合一的境界。荀子“制天命而用之”的思想中蘊含著豐富的人本主義思想,表現(xiàn)著對人的關(guān)懷,這對我們今天的現(xiàn)代環(huán)境司法也有其借鑒意義。 第五部分:荀子環(huán)保思想對公民環(huán)保意識的影響。早在戰(zhàn)國時期,荀子就已經(jīng)提出了“天人之分”、“節(jié)用御欲”和“謹其時禁”的觀點。當今社會,人們同樣要節(jié)用御欲、謹其時禁,只有這樣,自然界才能持久的為人類的生存和發(fā)展提供各種條件和環(huán)境,建立起適合人類永續(xù)發(fā)展需要的美好家園。 第六部分:結(jié)語。在當代學術(shù)界百家爭鳴、諸種思想激烈交鋒之際,重新厘清荀子的環(huán)保思想并對之加以新的詮釋,對于現(xiàn)代的研究也具有重要意義。在對前文進行概括的基礎(chǔ)上,總結(jié)我們在環(huán)境法治建設(shè)中應注意的問題,吸收荀子環(huán)境保護思想中的合理部分,以更好的維護我們共同的家園。此外,指出本文存在的局限不足之處。 相信在現(xiàn)代法治文化的支撐下,在民主的政治制度保障下,中華民族的傳統(tǒng)文化一定會迸發(fā)出蓬勃的生機,為我國的環(huán)境法治建設(shè)的發(fā)展帶來新的機遇。
